moving from LA to TX

My company has several branch offices and head office locates in Houston. before, I lived and worked in New Orleans office (LA). On 2.1.2021, company temporarily relocated me from New Orleans to Houston and lodged in apartment rented by company and changed to permanently staying in Houston from 05.01.2021. And then I started to rent apartment by myself.  The withholding LA tax was not stopped until my residency address was updated to Houston in June in payroll system. Which date is considered as my moving date or be resident of TX for the tax purpose?

From the information provided in your post, it would appear that the start of your residency in Texas would be 05.01.2021.  At that time your employer changed your payroll to the Texas office and you started to pay for your lodging which would support your permanent move to Texas.

 

Factors Establishing Texas Residency:

  1. Move To Texas. 
  2. Update Your Mailing Address. 
  3. Register Your Car in TX. 
  4. Get Your Texas Driver License or Identification Card.
  5. Register To Vote. 
  6. Find Local Professionals. 
  7. Update Your Estate Plan. 
  8. Get Your Pets Settled In.

one more question, may I file return to refund of LA state tax from Feb-April as the earning is out of LA

No, since you did not officially establish residency in Texas until May 1, you are still considered a Louisiana resident until then. 

 

You were not staying at your Louisiana home or earning income in LA from February to April. However, since it was your resident state, it still has the right to tax the income you earned during that time.
