If you and your husband are California residents but live in Virginia on PCS orders, your non-military Virginia job income is still taxable in California under the Military Spouse Residency Relief Act (MSRRA). You should select "Yes" for other state income since you earned the income in Virginia.

Ahhhh....I think it depends on what you informed your employer.

 

IF you gave your employer the correct withholding document indicating you were a CA spouse of a CA military member (form VA-4).... and not VA resident, then, as long as they did not withhold any VA taxes, then you don't have to file a VA tax return, and you would mark it a NO.   A lot of IF's.

Okay so it would be yes ? I believe I got confused with the type of income of ‘live in one state working in another” would count for me. I did have Va withheld on accident however to get the return I must file form 763-s paperly so I wouldn’t require a tax return in Va. would turbo tax generate this form?

It might create the 763-S....but I don't know for sure.....though it is on the TTX State forms list for VA.

 

BUT TTX would charge you ~$40 for it (extra State forms), and it's free as a PDF download from the VA website.
