The entirety of my question was omitted. 

 

I'm a full-time student who interned full-time in NY in 2011. I'm a nonresident of NY and most of my income was earned during 2.5 months of my internship. Do I need to file Nonresident Business Allocation? I wasn't physically in NY for the whole summer

Yes. You will need to file a nonresident New York return (IT-203) for your sourced income from the internship and a resident return with your home state. The tax liability to New York will be credited by your home state. 

 

Per NYS, a residence maintained by a full-time student enrolled at an institution of higher education in an undergraduate degree program leading to a baccalaureate degree and occupied by the student while attending the institution is not a permanent place of abode with respect to that student. However, the internship money you earned is New York sourced income and you still need to file a tax return for the state. 

 

In addition, please ensure you've filled out the Personal Info section correctly:

  1. With your return open, select My Info in the left-hand menu.
  2. Then, on the Personal info summary screen, scroll down to Other State Income, and select Edit.
  3. At the Did you make money in any other states? question, answer Yes and make sure your nonresident state is selected from the drop-down.
  4. Select Continue.

To ensure accurate calculations, always complete the non-resident (NY) return first for a credit of taxes paid to your resident state.

My question was about "Do you need to fill out the Nonresident Business Allocation Schedule to allocate NY state business income?" I'm wondering if I need to say yes or no to this question

This is not relevant to an employee, if the statement below is true, then yes.

 

An allocation of business income must be made if you are a nonresident and you carry on business both in and out of New York State.
