Question

Should I request a VA tax refund if I earned income in VA, but paid DC state tax where I have residency?

My husband and I are married filing jointly. We live in DC but my husband works in Virginia. At first I put that my husband is earning income in VA, so he should file a VA state tax return. But I noticed on his W-2 that his employer withheld DC state tax, due to the tax agreement between DC and VA. So there is not need to claim a VA tax refund. But Turbo Tax keeps asking me to make this correction. What should I do?

You may delete the Virginia return.  If no tax was withheld by Virginia, you will not need the return because of the reciprocal agreement you mention.  You can also revise some of your answers in TurboTax.  In the Personal Info section, you may answer "no" to the question if you worked outside of DC.  You are not considered to work in Virginia since you are not taxed there.
