topic back taxes in Tax law changes

I have three years of taxes that have been rejected. I just learned it was because i was claiming my nephew on them and i guess i needed to show proof of him staying with me. How could i do that and will i receive all three years? Or would it be easier just to Amend my taxes without him as a depended?

Hi @Optimistic_g,

Could you please further clarify for the rejection? Was the tax return rejected by the IRS and/or State Agency due to your nephew already being claimed on another return?

If you are not sure and you submitted your past returns through TurboTax, you can contact a Tax Expert who can help you pinpoint the exact reason of the rejection. You can also contact the IRS for more information.

If you nephew was claimed on someone else's tax return then you will need to discuss with the person who claimed your nephew. Here is the IRS link on dependent qualifications IRS Dependency. This link also includes examples and other helpful information.

If you do need to remove your nephew as a dependent, you can amend your taxes without him, but I would first verify exactly why your return was rejected and also if you have the claim of Dependency before you do so.

Take care!

Hi @Optimistic_g. I would recommend contacting the IRS directly to see if you can respond now to prove that your nephew resides with you so that you can claim him as a qualifying dependent. I would also suggest verifying that you will not have any issues claiming him as a dependent for the tax returns you need to complete.

If the IRS says that you cannot claim him as a dependent, I would then file an amendment for the tax year's applicable.

Here is the link to contact the IRS. Please note that it might be very busy right now due to the tax extension deadline for 2021 returns approaching on 10/17/22. I do advise calling first thing in the morning when they open at 7AM.

https://www.irs.gov/help/telephone-assistance

(Scroll down to "IRS Phone Numbers and Tax Help Options")

Enjoy your day!
