A lemon law settlement is only taxable for the part that exceeds your loss, which is the amount you paid compared with the fair market value of the 'lemon' &lt;U&gt;at the time you bought it&lt;/U&gt;.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Subtract the fair market value from $43,000 and compare the result to the $27,000 you received. If your loss is less than $27,000, then the excess would be taxable. Note that legal fees are not deductible.&lt;/P&gt;</description>

      <description>Thank you! I don't have to report this on my tax this year since I recently settled. When I file my tax next year,&amp;nbsp;&amp;nbsp;do I subtract the fair market value what the car is worth now or the fair market value when I file tax next year? What happen if I trade-in my car? And the trade-in value is less than selling the car privately. I can't sell the car because the Fair Market Value is a lot less than what I owed on the loan.</description>

We are trying to figure out if any of that is going to be taxed?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Here is the breakdown: T&lt;SPAN&gt;aking into consideration your total sales price, mileage offset, Mfg Rebate, and incidental damages your actual damages are $27,000.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Accordingly, there are $56,000 in additional damages here ($83,000 - $27,000). My cost of the vehicle was $34,200. So, if I do it as you are suggesting, would that confuse the IRS? I put the $20,300 in the 1099-MISC, and under the Miscellaneous Income, I put -$20,300. It zeroed out the amount due, but I am concerned that it might trigger the IRS to wonder what's up. I also did not get anything from the manufacture except the stub showing they paid me.&amp;nbsp; I also did not enter the original cost of the vehicle being $34,200 anywhere to show offset. Any help would be great.&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;How do you calculate the fair market value of a lemon at the time of sale? There is no market for defective new cars and outside of hiring an expensive expert witness, it would seem impossible for a layperson to calculate with any degree of precision. Any insight would be appreciated!&lt;/P&gt;</description>

      <description>&lt;P&gt;My lemon law case was handled by an attorney. My settlement included actual damages for the car plus additional damages. My attorney got paid 45% of the additional damages.&amp;nbsp; How do I report the additional damages and deduct my attorney fees?&amp;nbsp; Do i just include attorneys in the negative part?&amp;nbsp;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My attorney says additional damages from Lemon Law can be considered Civil Rights and thus exempt from taxes.&amp;nbsp; If that is true, how do i represent that?&lt;/P&gt;</description>

&lt;P&gt;Please enter that under "Income"&amp;nbsp;&lt;/P&gt;

&lt;P&gt;Be sure to select "This was money from a lawsuit settlement" on the "Does one of these uncommon situations apply?" screen&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;No, that is not completely true. The settlement will be free from Self-Employment tax (or FICA TAX) but will be taxable income as far as Income tax is concerned.&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;Additionally, unless the lawsuit is related to your business, the attorney fees cannot be deducted.&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;Yep, you pay tax on the income your attorney took.&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&lt;U&gt;&lt;STRONG&gt;According to the IRS:&lt;/STRONG&gt;&lt;/U&gt;&lt;/P&gt; 
&lt;P&gt;"Generally, individuals, as cash basis taxpayers, may deduct attorneys‟ fees in the year they are paid, assuming the attorneys‟ fees otherwise qualify as deductible"&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;This means, if they are allowed to be&amp;nbsp;deducted, you can deduct them.&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;But they aren't, unless you are Self-Employed.&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;(There was a time when a Taxpayer could possible deduct these fees, but not for tax year 2021)&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt;

      <description>&lt;P&gt;I have the same situation and am wondering how would anyone know the FMV of the "lemon" at the time they bought it.&amp;nbsp; Bought for 38k.&amp;nbsp; Lemon law settlement was 65k which included paying off my loan.&amp;nbsp; What is my loss/taxable amount?&amp;nbsp; Never received a 1099. The fogginess of this subject is maddening.&amp;nbsp; I've been everywhere trying to figure out how you know the FMV of a lemon when you bought it (assuming it's impaired when you buy it).&amp;nbsp; If it's unusable then it's -0- and my loss is $38k - but if they paid off the loan, then how am I at a loss?&amp;nbsp; SO confusing&lt;/P&gt;</description>

      <description>&lt;P&gt;&lt;SPAN style="font-family:Arial, Helvetica, sans-serif;font-size:14px;"&gt;Yes, it is a foggy subject. &amp;nbsp;From what you posted you paid 38K for the vehicle and received 65K as a settlement part of which paid off your loan. &amp;nbsp;Presuming your loan payoff was 38K you would have &amp;nbsp;27K remaining. &amp;nbsp;You actually do not have a loss the settlement paid off your loan and you still had leftover cash from the settlement.&lt;/SPAN&gt;&lt;/P&gt;</description>
