I received stocks as an inheritance and sold them almost immediately. while waiting on the legal process the stock gained about 10,000.00 do I claim this gain only taxes or not because they weren't officially in my name?

Depends on whether the stock was considered still in the estate or when it was considered your inheritance which is a legal rather than a tax question. An estate attorney can advise you or you can wait to see the name and social security number on the 1099-B which will be issued.
