The question of how to report a stipend from a student summer internship has been addressed multiple times but I can find no clear answer. A 10 week summer internship at a national lab provided a 1099 MISC as a stipend, and while I know how to get around using the schedule C from answers provided here, reporting it as other income makes it unearned income and triggers the kiddie tax! I am looking for a legitimate way to report this as earned income (and not self employment income or a scholarship) which would seem to reflect the "spirit" of IRS guidelines, in that it really doesn't fir the definitions of self employment OR unearned income. Any assistance would be appreciated!

Q. Looking for a legitimate way to report this as earned income (and not self employment income or a scholarship).

A. It doesn't exist.

Academic stipends are typically reported as taxable scholarship*, depending on the setting (what does "national lab" mean).

Internship is normally wages and is subject to social security and medicare tax, either as W-2 withholding or self employment tax (and a 1099-NEC, rather than 1099-misc).

*Scholarships are a hybrid between earned and unearned income. It is earned income for purposes of the $15,750 filing requirement (2025) and the dependent standard deduction calculation (earned income + $450). It is not earned income for the kiddie tax and other purposes (e.g. EIC). For grad students and post grad fellows, scholarship, stipend and fellowship income is earned income ("compensation") for IRA contributions.

Taxable scholarship goes on line 8r of Schedule 1, from which TT treats it as hybrid income.

In TT, enter stipend/scholarship in the 1098-T interview as scholarships not shown on the 1098-T.

Thanks. So there a paid internship program sponsored and paid for under the Department of Energy's Office of Science’s Office of Workforce Development for Teachers and Scientists (WDTS) which works in collaboration with DOE laboratories/facilities across the country. While you must be a college student with a 3.0 or higher GPA to be considered, I have trouble characterizing it as a scholarship/fellowship under IRS guidelines. It didn't take place at a university, nor was it directly related to the college program. Having said that, I would like to be enter it as such, and do it the way you said (not under scholarships on schedule 1, line R?) because then it would in fact not be taxed as unearned income, and the kiddie tax would not be triggered I believe.

A "paid internship program sponsored and paid for under the Department of Energy's Office of Science’s Office of Workforce Development for Teachers and Scientists (WDTS)" sounds like a "stipend". I would enter it as scholarship (Schedule 1, Line 8r). The first $15,570 will avoid the kiddie tax.

Otherwise, you report it as self employment subject to 15.3% self employment tax*. You enter at the 1099-Misc section and answer that your intent was to earn money.

*Effectively 14.13%, instead of the stated rate of 15.3%, after the convoluted calculation.

Thank you again. Yes, while I do not think it clearly fits the definition of a scholarship, it is indeed considered a stipend. That is how the organization classifies it, and yet I can't find use of that word in particular in any IRS guidance.

Please forgive me for asking this, I did think I knew how to do it but other than trying to override the schedule 1 to get the information on line 8r, how do I answer the questions in TT to get it to go there? When I do enter on the schedule 1 myself, it does still trigger the kiddie tax (gets recorded on line 8 of 1040). There is also some regular w2 wages but total off all remains at about 11k.

Thank you SO much for your help!

It will tell you that the Kiddie tax form 8815 is trigger (and you can't use the free edition of TT) but there is no actual kiddie tax because his taxable income is $0 (his standard deduction is more than the $11K "earned/hybrid income"). See the calculations on form 8815.

Q. Other than trying to override the schedule 1 to get the information on line 8r, how do I answer the questions in TT to get it to go there?

A. The way to enter stipend/scholarship income, in TurboTax, is at Deductions and Credits / Education / Expenses and Scholarships.

After answering no to having a 1098-T*, answer yes to qualifying for an exception (that gets you to the entry screens). You will have to go thru the whole education interview to get to the scholarship screen. At the scholarship screen, enter the amount of the grant. When asked if any was used for room and board, answer yes. Then enter the amount you want to be taxable (usually all of it), in the pop up box. R&B are not "qualified educational expenses". So, this is how you tell TT that it is taxable. Note the wording at that screen “or other expenses”. You didn’t have to literally use the scholarship for R&B. This will put it on line 8r of Schedule 1.

*If you do have a 1098-T, one of the follow-up questions will be do you have any scholarships not shown on the 1098-T. Enter the additional scholarship/stipend there.

I am still finding scholarship or other income from box 3 being unearned, but either way, if he is claimed can or is by the parent the standard deduction becomes only about 5k.

Thanks.

Someone who can be claimed as a dependent receives a standard deduction that cannot exceed the greater of:

Q. I am still finding scholarship or other income from box 3 being unearned?

Yes. If you enter it as box 3, 1099-Misc income it will end up as either unearned "other income" (line 8z Schedule 1) or self employment income (Schedule C) depending on how you respond to the follow up interview.

To get it treated as hybrid stipend-scholarship income, it must be reported on line 8r of Schedule 1. To get it there, you must enter it in the Educational expenses-Scholarships section, under deductions and credits. Do not enter it in the 1099-MISC section under Wages and income.

If you're concerned about the 1099-Misc not showing up on the tax forms, there's a workaround for that. But, it's not necessary.

Report the scholarship income, on Schedule 1, line 8r. Enter as previously described.

Then also report the 1099-Misc as other income, line 8z, Schedule 1 income (enter in TurboTax at the 1099-Misc screen). Then enter an offsetting line 8z deduction, for the same amount. In TurboTax (TT), enter at:
- Federal Taxes tab
- Wages & Income
Scroll down to:
-Less Common Income
      -Misc Income, 1099-A, 1099-C
       - On the next screen, choose – Other reportable income - Answer yes to Any other Taxable Income

-On the next screen, Enter the number with a minus sign (-) in front. Briefly explain at description, e.g. "1099-Misc reported as scholarship"

So, in the end I think I found my own solution.

I read up on how the IRS defines self employment, earned income and scholarship/fellowships and

and based on such, am comfortable in what I intend to to. I am not sure Turbo Tax is asking the right questions to be honest (though it did in the online version, not software that I could see), because I was able to generate an 8615 worksheet which allows you to enter the child's other earned income, which this stipend clearly was, and then the problem disappears (no longer shows up as unearned income). This then does not impose the kiddie tax.

In the end, the child still owes less than the parent loses by claiming them (since they CAN b claimed, even if they aren't they don't get the AOC for example) so that's probably the route we will take.

Thanks.

Thanks. This is another reason why Turbo tax putting the income from a 1099 MISC as unearned income is a problem. it lowers the deduction significantly, whereas if it was recorded as earned income (which it is) the amount of the deduction would be close to $12k instead of the 5k I am now (because of other W-2 employment).

While I figured out how to count the 1099 MISC income as earned income for purposes of the kidding tax, I cannot figure out if/how to over ride Turbo Tax to make it earned rather than unearned income for purposes of the 1040 itself. Any ideas?

Q. I cannot figure out if/how to over ride Turbo Tax to make it earned rather than unearned income for purposes of the 1040 itself. Any ideas?

A. As previously explained, it should to be entered as taxable scholarship. That's the "right way" to do it, in my opinion. I have answered this same basic question, dozens of times that way. This is less likely to wave a red flag than any other way.

Yes I know you have offered that as a solution, but no matter how I slice it I just don't see a good way to make it fit in that definition. Even when I find guidance using a stipend under that category it says if a W2 or 1099 was NOT received, which in this case it was. While the return is for a full time student, it had nothing to do with paying for school. Believe me, I wish I could be comfortable doing it that way, but frankly this question was directed to the person who answered about the standard deduction. Sorry if it didn't appear that way.

(I have also considered your second solution, but what concerns me there is again is says NOT reported on a 1099.)

Thanks.

No offense taken

Your concerns are frequently expressed in your situation. Because the 1099-MIsc was issued there is no way to avoid a red flag at the IRS, except to report it as unearned income (the1099-Misc is used for reporting unearned income). I think fiddling with the 8615 worksheet is a bigger red flag, as well as reducing the student's standard deduction

The technique described above (repeated below), to enter a negative offset, is frequently recommended, in this forum, when a 1099-Misc is erroneously issued, not just in stipend situations. But I don't think it's necessary in your situation.

_____________________________________________________________________________________________

AI answer to google search for are stipends taxable:

How you report a stipend depends on your relationship with the payer:

Employees: Taxable stipends are often reported on a Form W-2 in Box 1. Employers typically withhold income, Social Security, and Medicare taxes from these payments.

Non-Employees/Contractors: Payers may not withhold taxes. If the amount exceeds $2,000 in 2026 (increased from $600 in 2025), you may receive a Form 1099-MISC or 1099-NEC.

Students: Taxable portions not reported on a W-2 should be reported on Form 1040, Schedule 1, Line 8r as "Scholarship and fellowship grants".

Thanks.

I hear what you are saying about the red flag but truth be told the income is so low that as long as it is considered earned income, this student arguably wouldn't even have to file, let alone get hit with the kiddie tax. In fact, the student in question is a triplet and his brother got a W-2 for his internship and there are no problems at all. Additionally, had they sent nothing at all instead of this 1099 MISC it would also be easier to enter as earned income!

I assure you I have done multiple google searches in hundreds of ways at this point. As previously noted, not only does the situation not fit the definition of a scholarship (was not meant to pay for school) but even with the wording you have there, once a 1099 MISC is issued it negates the next line in my view. I truly wish I could be comfortable suing it that way. I have gone so far as to read the legal statues and as much IRS documentation as I can. I give you this as one example of many from Cornell Law:

26 U.S. Code § 117

If I weren't using a computer program, I would report this 1099 MISC under "other income" (Line 1h of the 1040). Then like in the old days, the 1099 MISC would be mailed in and would not have further information about how this job was structured and completed. How would that be wrong?
