    <description>&lt;P&gt;Hello,&amp;nbsp;&lt;/P&gt;&lt;P&gt;1. My child e-filed her own tax and checked a box that somebody may claim her as dependent. I am planning to e-file my own tax claiming her as dependent. Can I e-file my tax? I was told that IRS will reject mine and I need to payer file my tax. Is it true?&amp;nbsp;&lt;/P&gt;&lt;P&gt;2. Is there any income limit of a child for me to claim a child as dependent?&amp;nbsp;&lt;/P&gt;&lt;P&gt;3. My child e-filed and entered the info of 1098T. I paid most of the tuition. Can I enter 1098T info when I file my tax.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thank you for your assistance.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;If your child DID check that they can be claimed as someone else's dependent you will not have a problem when you claim them and try to e-file.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;If your child made the very common mistake of saying no one could claim them----that is when you have a problem and your e-file will be rejected. &amp;nbsp;If that happens, your own return will need to be filed by mail. You will not be able to e-file this year. &amp;nbsp; And your child will have to amend their return to change that answer in MY INFO. &amp;nbsp;You do not have to wait for them to amend. &amp;nbsp;You can mail your return when it is ready to go into an envelope.&lt;/P&gt;</description>

&lt;P&gt;&amp;nbsp;&lt;/P&gt;

&lt;P&gt;A. There's a grain of truth there. If she did not check that box, you would be prevented from e-filing.&amp;nbsp;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Q. Is there any income limit of a child for me to claim a child as dependent?&amp;nbsp;&lt;/P&gt;
&lt;P&gt;A. Simple answer: No.&lt;/P&gt;
&lt;P&gt;There are two types of dependents, "Qualifying Children"(QC) and Other ("Qualifying Relative" in IRS parlance even though they don't have to actually be related). &lt;STRONG&gt;There is no income limit for a QC&lt;/STRONG&gt; but there is an age limit, student status, a relationship test and residence test.&lt;/P&gt;
&lt;P&gt;A child of a taxpayer can still be a “Qualifying Child” (QC) dependent, regardless of his/her income, if:&lt;/P&gt;
&lt;OL&gt;
&lt;LI&gt;He is under age 19, or under 24 if a full time student for at least 5 months of the year, or is totally &amp;amp; permanently disabled&lt;/LI&gt;
&lt;LI&gt;He did not provide more than 1/2 his own support. Scholarships are excluded from the support calculation&lt;/LI&gt;
&lt;LI&gt;He lived with the parent (including temporary absences such as away at school) for more than half the year&lt;/LI&gt;
&lt;/OL&gt;
&lt;P&gt;If your child does not meet the rules for being a QC, then there is an income limit of $5050 to be a Qualifying Relative.&amp;nbsp;&lt;/P&gt;

&lt;P&gt;A. Yes. Since the student is your dependent, only you can claim the tuition credit and you should enter the 1098-T to do so.&amp;nbsp; Just because your student entered the 1098-T, in TurboTax(TT), does not mean she actually "filed" it. TT should have told her that she did not qualify for the credit.&amp;nbsp; If her scholarships exceeded her tuition, TT would treat the excess as taxable income.&amp;nbsp; If this is the case, replay back for instructions. There is a loop hole available to allow you to still claim the tuition credit.&amp;nbsp;&lt;/P&gt;
