      <description>&lt;P&gt;Neither of you is able to claim&amp;nbsp;&lt;A href="https://www.irs.gov/publications/p970/ch04.html" rel="nofollow" target="_blank"&gt;student loan interes&lt;/A&gt;t at this point, unfortunately. &amp;nbsp;&amp;nbsp;&lt;B&gt;You&lt;/B&gt; &lt;U&gt;&lt;B&gt;must be legally obligated &lt;/B&gt;&lt;/U&gt;to pay the loan in order to deduct it (your name must be on the loan). &lt;B&gt;Your dad&lt;/B&gt; &lt;U&gt;&lt;B&gt;must actually make the payments&lt;/B&gt;&lt;/U&gt; in order to deduct it on his tax return.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Note: If your name was on the loan and parent paid it, you would have been able to deduct it since you are no longer claimed as a dependent.&amp;nbsp;&lt;/P&gt;</description>
