      <description>&lt;P&gt;Yes, you can file form 8379 with your tax return to prevent the IRS from offset your share of the refund.&lt;/P&gt;

&lt;P&gt;&amp;nbsp;&lt;/P&gt;

&lt;P&gt;If as you said, your wife is the breadwinner of the family, all or most of the refund may be her share and will be offset to repay her delinquent student loans.&lt;/P&gt;
