If you have no income or expenses to report for a line of business, you do not have to file a Schedule C and therefore do not need the small business option.

I do have expenses that I need to deduct, would I still need the software?

Yes. Since you are reporting business activities you will still need to file a Schedule C to claim those expenses and therefore need the business version of the software.
