    <description>&lt;P&gt;Hi, My wife passed away in February of 2025 and she was the sole creditor on a credit card. The credit card company sent a 1099-c in the mail, addressed to her (but at my address, dated 11/24/2025).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;We have a trust and my attorney says on the date of our death all her assets go into the trust and her estate is not probated (because of the trust). I started to file our 2025 tax return and was going to file it joint married and head of household. Do I need to include the right off amount on the tax return? If so which form do I file it on?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;It is my understanding that when a spouse passes away then there is no liability for the surviving spouse b/c the debt is not in their name, is that true?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks&lt;/P&gt;</description>
