Enter the child as a dependent on your tax return. You will have to print and mail the return, it cannot be e-filed.

The IRS will pay the refund shown on your tax return, if any.

See this for how to print a tax return for mailing - https://ttlc.intuit.com/turbotax-support/en-us/help-article/printers-printing/print-mail-return-turbotax-online/L5bwuqXGy_US_en_US

Within a year the IRS will be investigating this problem. The will mail instructions to both parties on what to do. The loser of the investigation has to pay back any tax refund based on the wrongfully claimed dependent plus interest and penalties.

It will also help expedite things if you include a note that states another taxpayer claimed the child, The reason they don't have the right to, their ss#, form 8832 I think that is the form showing you have the right to claim them, and also the legal statement, if you have one such as a divorce decree or custody disposition proving your statement. It is likely they won't even have to contact you if you include the proof.

Do not change your return and do not remove your child. As long as this is your child and you meet the requirements for claiming your child as a dependent, you should file as normal but will have to mail the return as indicated by DoninGA.

Who can I claim as my dependent?

Rules for Claiming Dependents on Taxes

A person who tries to claim a child and is not the custodial parent is not allowed unless you have signed a Form 8332 allowing the non-custodial parent to claim the child.
