    <description>&lt;P&gt;I have been in the US for 365 days every year for the past three years (2023, 2024, 2025) on H-1B visa, and have been using 1040 to file my taxes. So this year I sold my property on Jan 12th, which doesn't make me meet the substantial presence test rule #1 that having to be in the US for at least 31 days in current year since it's Jan 12 is 12 days only; so should I have FIRPTA applied to me or not?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks&lt;/P&gt;</description>

      <description>&lt;P&gt;It depends. &amp;nbsp;If you moved out of the United States (US) on January 12 and &lt;STRONG&gt;will no longer be present in the US&lt;/STRONG&gt; for the rest of 2026, then you &lt;STRONG&gt;would not&lt;/STRONG&gt; meet the qualifications to be a considered a US person (for tax purposes) under the &lt;A href="https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test" target="_blank"&gt;&lt;STRONG&gt;substantial presence test&lt;/STRONG&gt;&lt;/A&gt; and&lt;STRONG&gt; will be&lt;/STRONG&gt; subject to FIRPTA withholding on the sale of your property. &amp;nbsp;If you &lt;STRONG&gt;plan to be in the US for at least 31 days&lt;/STRONG&gt; during the 2026 tax year, you may &lt;STRONG&gt;still be considered a US person for the year&lt;/STRONG&gt; under the substantial presence test and you &lt;STRONG&gt;may be exempt&lt;/STRONG&gt; from FIRPTA withholding. &amp;nbsp;You will need to &lt;STRONG&gt;provide a certified written statement to the buyer&lt;/STRONG&gt;, that &lt;STRONG&gt;you are not a foreign person&lt;/STRONG&gt; and &lt;STRONG&gt;are not subject to FIRPTA&lt;/STRONG&gt; withholding (see &lt;A href="https://www.irs.gov/individuals/international-taxpayers/exceptions-from-firpta-withholding#:~:text=The%20seller%20(transferor)%20gives%20the%20transferee%20a%20certification%20stating%2C%20under%20penalties%20of%20perjury%2C%20that%20the%20transferor%20is%20not%20a%20foreign%20person.%20The%20certification%20should%C2%A0contain%C2%A0the%20transferor%27s%20name%2C%20U.S.%20taxpayer%20identification%20number%2C%20and%20home%20address%20(or%20office%20address%2C%20in%20the%20case%20of%20an%20entity)." target="_blank"&gt;#4 Exceptions to FIRPTA withholding&lt;/A&gt;).&lt;/P&gt;

&lt;P&gt;Another thing to consider is that in most cases, it is the &lt;STRONG&gt;buyer's (transferee's) responsibility&lt;/STRONG&gt; to determine if FIRPTA withholding is required, &lt;STRONG&gt;not the sellers&lt;/STRONG&gt;. &amp;nbsp;The buyer is considered the &lt;STRONG&gt;withholding agent&lt;/STRONG&gt;. (see &lt;A href="https://www.irs.gov/individuals/international-taxpayers/firpta-withholding#:~:text=In%20most%20cases%2C%20the%20buyer%20(transferee)%20is%20the%20withholding%20agent.%20The%20transferee%20must%20find%20out%20if%20the%20transferor%20is%20a%20foreign%20person.%20If%20the%20transferor%20is%20a%20foreign%20person%20and%20the%20transferee%20fails%20to%20withhold%2C%20the%20transferee%20may%20be%20held%20liable%20for%20the%20tax." target="_blank"&gt;FIRPTA withholding agent&lt;/A&gt;).&lt;/P&gt;
