I also clicked the can be claimed as a dependent even though my parents did not claim me, I’m 25 out of college and work in a totally different state than my parents and have not been claimed in 2 years. I did this out of habit, I didn’t think it mattered but it definitely does now. I really need this stimulus more now than ever after being laid off of work and it’s been pretty stressful. I filed an amended 1040X in hopes for the best. We also should get some type of group going for people in this situation so maybe they can back check for info or something instead of an algorithm that isn’t accurate. There’s a whole lot of people in this situation an it’s just an accident.

So.. hear me out.

This was my first time filing my taxes ever, I just started my first job ever last year. I do live at my parents house but I earn more than 10k a year. Obviously my mom didn't claim me as a dependent because I make my own money now.

My question is, what information is the treasury using to determine who gets a stimulus check? My mom did not claim me as a dependent, I selected the dependent check box but will whoever is working on those stimulus checks notice that nobody actually claimed me as a dependent even though I clicked on the box?

Thanks!

If you checked the box, on your return, that says you can be claimed as a dependent; you will not be getting a stimulus check. The IRS will not be checking to see if you were actually claimed.

This question has come up lot, here in this forum, and what is not clear is: what happens if you file an amended return to uncheck that box.

But, if you don't get it this year, you'll get it next year (if you still qualify). Under the CARES Act, if you are claimed as a dependent (or qualify to be claimed) on someone else’s return you cannot receive a stimulus check, in 2020. If you could be claimed as a dependent for 2019, but will not be for 2020, you will most likely get it in 2021.

"In essence, the stimulus check acts as an advance of your 2020 income tax refund. This means when you prepare your 2020 income tax return, there will be a line to include the section 6428 credit. The credit on your 2020 return is subtracted by any amount received as a stimulus check in 2020. If the amount you received as a stimulus check is less than the credit you are due, the difference will be included as part of your 2020 refund. If you have been overpaid by receiving the stimulus check, however, you will not be required to return any excess amount".

No, the current guidance is that stimulus checks will be paid according to the 2019 tax return filing. If this was not filed, then the 2018 tax return will be used. For anyone that was claimed or could have been claimed as a dependent, there is no eligibility for a stimulus check as Champ @Hal_Al stated.

I recommend confirming whether or not you really are a dependent. Check 2019 Publication 501 Dependents, Standard Deduction, and Filing Information on page 4 and page 11 to determine if you are or are not qualified to be a dependent as a qualifying child or as a qualifying relative.

You can file an amended return to be independent. But, this is sent in through the mail and takes 16 weeks to process. It is best to pay the extra money and send it certified mail so you have proof. Click the link for instructions: How to amend (change or correct) a return you already filed

In the meantime, you can visit the following links for the most recent updates:

IRS Coronavirus Tax Relief

TurboTax Corona Virus Tax Center Updates

@sasha03m

Do you recommend filing the amendment now? I just read that the IRS is no longer processing paper returns. I'm in a similiar situation & wondering if I should leave it until later. I do appreciate the information on whether or not the IRS checks to see if you were actually claimed.

I’m in the same boat as you... I filed as a dependent out of habit, for when I was still going to school. However, I found out they have not claimed me for the past couple of years. They did not claim me this year either, but the IRS will be going off of your filing status. Not by whether you were actually claimed. We are both screwed. Misery loves company I guess.

My account got adjusted the 27th of March, but when i checked the status of my stimulus it said that it wasn't able to process if i am eligible. Can someone help me out? Will i still be receiving the stimulus check.

I just started my first job ever last year. I do live at my parents house but I earn more than 10k a year.

If, on Dec 31 of the tax year you were:

- Under the age of 19

 *******************OR*****************

Under the age of 24 and a full time college/High school student for *ANY* *ONE* *SEMESTER* that started in the tax year and;

*YOU* did not provide *MORE* than 50% of your own support for the *ENTIRE* tax year, and;

Were enrolled in a course of study at an accredited learning institution that will lead to a degree or certification, then;

Your earnings *DO* *NOT* *MATTER*. You could earn a million dollars (literally!) and still qualify as a dependent on your parent's tax return. Understand that there is *NO* requirement for your parents to provide you any support. Not one single penny. The support requirement is on you, and only you. Since you only made about $10-11K in 2019 *AND* you lived with your parents, there is no way possible on this green earth that you provided more than 50% of your own support. Therefore your parents' qualify to claim you as a dependent.

Now understand this: Your parents have a choice. *You* do not have a choice. You "MUST" select the option for "I can be claimed on someone else's return" and it flat out does not matter if your parent's claim you or not. THe key word here is *QUALIFY*. If the above conditions are true, then your parents qualify to claim you on their tax return, and it flat out does not matter if they actually claim you or not. You have no choice but to select the option for "I can be claimed on someone else's tax return" weather your parent's actually claim you or not.

Additionally, dependents *over* the age of 16 on Dec 31 of the tax year do not qualify the parents for the additional $500 per dependent.

Hey, I'm in a situation as well.

This year, I accidentally filed as a independent, (my first year filing taxes), though I am usually a dependent. I recently got my refund, and was looking to file an amended return. However, I received the stimulus check, and I have not yet made motions for the amended return. Is it still necessary to do so? Are there any potential consequences since I recieved the check? I am 18 and so it is obvious that college students are typically not eligible as dependents. In 2020 though, I plan to file as a dependent. Will I have to pay the money back, or have problems with my tax credit for next year? My income is way below the limit for dependents, and will most likely be the same next year.

Can someone help me out? In 2019, I moved out of my mom’s house in April. I’ve lived with my boyfriend at his moms ever since. The only bill my mother pays of mine is my phone bill. I pay for my college, car, car insurance, and anything else I want or need. I checked the box also that says “can you be claimed as a dependent?” No one claimed me as a dependent though. What can I do?

hey @Mizmokitty22 . I’ve made the same mistake unfortunately.. From what I’ve seen, one source says that if you were not claimed that you may still be eligible. However, the IRS page makes it seem that if you filed that you can be claimed then you are ineligible. The only thing I’m aware that we can do is try to amend your tax forms, send it in & hope for the best. Of course this will take a couple weeks for it to be finalized.

I would recommend that you wait for somebody with more expertise to use to chime in before you do so. In the meantime, check out irs.gov/Coronavirus/get-my-payment to see your current status on receiving the “Economic Impact Payment”. I foolishly did so only after filing the amendment, so it says status unavailable. Hopefully you’re in the clear to get it though!
