    <description>&lt;P&gt;So I am a college student, 21 years old, I do not live with my parent for more than half the year, she does not pay my bill and I make around 10 K a year is she able to claim me as a dependent I learned that she has been claiming me and that has been making me owe the state money every year. what happens if I amend this years return but she has already claimed me? What does that do to her and how will it affect me?&lt;/P&gt;</description>

      <description>&lt;P&gt;If you do not qualify, and it appears that you don't, she is not entitled to claim you. If she did, and you also claim yourself as independent, the IRS should contest it and allow you to keep your refund. If you have been filing as independent each year, this should have already happened in the past.&lt;/P&gt;

&lt;P&gt;&amp;nbsp;&lt;/P&gt;

&lt;P&gt;If you have a problem with the state, contact them. Your returns should speak for themselves. If she is determined to be in the wrong, she will have to pay back Federal and the state.&lt;/P&gt;</description>

&lt;P&gt;If her home would be your home except that you are away for school then it counts as time lived with her.&amp;nbsp; The amount of your income does not matter as longs as you did not pay more then half of your total support for the year.&amp;nbsp;&amp;nbsp; Student loans in your name counts as support that you provide.&lt;/P&gt;
