&lt;P&gt;&lt;SPAN style="font-size:14.0pt"&gt;&lt;SPAN style="font-family:Calibri"&gt;&lt;EM&gt;"A taxpayer takes a treaty-based return position by maintaining that a treaty of the United States overrules or modifies a provision of the Internal Revenue Code and thereby causes (or potentially causes) a reduction of tax on the taxpayer’s tax return."&lt;/EM&gt;&lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;
