      <description>&lt;P&gt;I have to file in MD to get overpayment of unemployment withholding. I did not live there and had no income. I lived in NM and CA. Got stuck in CA due to COVID-19. Do I need to file in all three states? &amp;nbsp;Help!&lt;/P&gt;</description>

You would file a part-year resident return for New Mexico and&amp;nbsp;a part-year resident return for&amp;nbsp;California because they require part-year residents to file as long as a taxpayer is filing a federal return. &lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;

&lt;P&gt;&amp;nbsp;&lt;/P&gt;

&lt;P&gt;&lt;SPAN style="font-size:14px"&gt;&lt;SPAN style="font-family:Arial,Helvetica,sans-serif"&gt;You will also need to file a&amp;nbsp;non-resident return for Maryland.&amp;nbsp;&lt;/SPAN&gt;&lt;/SPAN&gt;&lt;SPAN style="font-size:14px"&gt;&lt;SPAN style="font-family:Arial,Helvetica,sans-serif"&gt;Per the Comptroller of Maryland,&amp;nbsp;If Maryland tax was withheld from your unemployment, you must file to obtain a refund of the withholding. Although you did not live or work there, in order to get a refund of withholding, you must file a non-resident return to do so.&amp;nbsp;&lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;</description>
