Since she moved out of NY before earning money, she will not file for NY. She made too little money to file in MD or in VA.

Coleen,

My daughter moved from Maryland to New York on 6/1/19 for a 3 year graduate school program. She is now a New York Resident with a NY drivers license and her federal tax return will be sent to her new address in NY. She made $1,303.42 in Maryland as waitress in 2019. She also made $970.20 in Virginia when she was going to undergrad school in 2019. Doesn't she have to file in order to get the tax return she paid for Virginia and Maryland ? Also, when she has a two week break in the summer and works her waitress job in Maryland does she need to give her employer her new home address in NY? When she does this will they take out New York taxes out since she is a NY residence?? Thanks for your help

Yes, she will need to file a state return for those states in order to claim a refund for tax withheld. If she works in Maryland, then she will have Maryland tax withheld even though she has a New York state address.

My turbo tax software only allows for 1 state. I will use Maryland since that is where she made the most money. The Virginia W2 only shows $30.00 taken out for VA state tax. Is there a fee Turbo tax online service I can use to get this return? Finally, does she have to file NY state tax return if she did not work in NY???

In the Desktop program you get 1 free state program download. You can buy the other state downloads. Go to the State tab.

Then each state return including the first one is 24.99 to efile or you can print and mail state for free.

It depends if anything else was earned while she lived in New York whether she would need to file a Part-Year Resident return for New York in 2019. She will definitely need to file New York in 2020 since she is a resident.

Please see the 2019 New York IT-203 Part Year and Nonresident Instructions, page 7 for How are nonresidents and part-year residents taxed? and Who must file?

2019 New York IT-201-I Resident Instructions for your reference in 2020
