topic I currently live (rent) and work in North Dakota, but I am still a Minnesota resident. I do not go to school, my parents do not claim me as a dependent, and my employer know's I am a MN resident. Do I just not include that I live in ND on my taxes? in State tax filing

IF you are only in ND on a temporary basis to work, and the employer is withholding MN taxes, then you say No to working in another state. The ND-MN reciprocal tax agreement allows you to do so.

BUT

IF you are remaining there for the forseeable future...then you did "move" to ND, and should be paying ND taxes. As a part-year resident for the year you "move" and then as a full year resident for subsequent years....and register your car, get Driver's lisc, Insurance.....register to vote in ND...etc..etc

______________________________________________

As you note...college students with parents in MN remain MN residents...Military people with HOR in MN and their spouses may also be able to claim MN residence even if posted in ND

Yes...but only If no ND taxes were withheld on your ND W-2....and you are continuing to claim MN residency

But first, before you do that, it would help if you went to the Personal Info page...and down at the bottom you would take out ND as the "Other State Income" state. Then go to the state section and delete ND

What is your employer is withholding ND and not MN? Should I have them change that moving forward to only deduct MN taxes?

All of my other details are the same as this clients. I live (rent) in ND but I have not changed my residency from MN to ND and I don't plan on doing that. Eventually I want to long term reside in MN.

@SteamTrain

@paigelaurenm

That's difficult to determine. Depends on how long you are there.

IF you are working/living in ND more than 6mo-1yr , then you ARE an ND resident and you will likely be considered an ND resident by ND....even if you have not changed your Dr Lisc. Intending to move back to MN "someday, someyear" is a hazy intention, an may not relieve you of the responsibility to file as a ND resident and pay full ND taxes as such. (The only exceptions might be if you are a college student or in the military )

________________________________

BUT, For a truly temporary job in ND of 6 mo or less, then you should only have MN taxes withheld, and only file MN as a resident....but if ND taxes were already withheld, then you'd have to file in ND as a nonresident and claim zero ND income to get the ND withholding back.

_______________________________

** This is a non-professional opinion only.
