I own a property in California and am planning to move abroad temporarily. I intend to rent out my California property, and a property management company will handle the rental.

Since I’ll be living outside the U.S., I’m wondering if I can still maintain California residency for tax purposes. Additionally, I’d like to know if there are any options for avoiding or reducing the 7% nonresident withholding tax on rental income from California.

As a retired member of the military, I’m also curious about how others in my situation typically handle these matters.

Any advice or guidance would be greatly appreciated!

Yes, you should be able to maintain your CA residency if you still have a California mailing address since your move is temporary.

California nonresident property owners may qualify for a waiver or reduced withholding. To request a waiver from withholding submit Form 588, Nonresident Withholding Waiver Request. To request reduced withholding submit Form 589, Nonresident Reduced Withholding Request.

Please view this link on information on how to apply for the waiver. Note, if you choose to be a California resident as mentioned in the first paragraph, you won't be eligible for this waiver.
