I live and work in MI but my employer is in IN. They held IN taxes in 2023 but when I did the non-resident return, IN still kept money for the county taxes that was not refunded to me. They said they were owed for working there, even though I remained in MI for the entire year. It did not give me an option to leave the county worked in blank and a selection had to be made to continue with the form. They accidentally held those same taxes for part of 2024 (until I noticed and had it fixed) and I am concerned I will be on the hook for county taxes where I did not work. How do I ensure my county taxes will be refunded?

To obtain a refund of incorrectly withheld Indiana state/county income taxes, file Indiana Form IT-40RNR and (as per the form instructions) leave lines 1-6 blank. You can download the form with its instructions here:

Q. They took me for the county tax money for 2023 and I am trying to avoid it happening again for 2024.

Your employer made the mistake by incorrectly withholding county tax. You, apparently, have gotten then to stop doing that. You are entitled to refund of the county withholding that did occur. You will have to file an IN state return (there's a section for county tax) to get that refund. You should mail in your IN return and attach a statement of explanation.

It is also not too late to file a 2023 IN return for a refund for that year.

For others reading this, be advised that if you physically work in IN, you are required to pay IN county income tax. The reciprocity agreement, between IN & MI, does not apply to local city or county taxes. You are not entitled to a refund of the city/county withholding (box19 on your W-2), unless there was an error in the amount.

A 2023 tax return can only be printed and mailed, it cannot be e-filed using TurboTax.
