My employer withheld NYS local taxes (Box18 of my W-2) on my full year's wages. I only lived in NYS for 3 months, therefore, I would like a refund of the local taxes paid. I cannot find a form that will allow me to file for this credit. Is there one?

My employer will not adjust my W-2 to include only my earnings as of 3/31/2021 in Box 18. If I change it just for seeing how the numbers change, my refund increases substantially. I need to know how to claim this credit, please.

What state were you working in after you moved out of NY? Which state did you move to? If you were still working in NY, you would still have to pay taxes to NY for the entire year.

You would file your NY IT-203 for Non-resident and Part Year Resident return, then you would file your state return where you lived after leaving NY. Most states will then give you a credit for the taxes you paid to your non resident state.

I moved to NJ from NY. My problem is New York City local taxes requiring Form IT-360.1. Sorry if my first explanation was not clear.

The main problem is my W-2 from NYS: In Box 18 it shows my full 2021 earnings because my employer made an error and continued the deduction for city (local) taxes throughout the year. It should have taken the local taxes for only Jan - Mar, 2021. It is a joint return, my W-2 is incorrect and my spouse's W-2 is correct (stopped taking the deduction after 3/31/2021 and recorded Box 18 correctly, that is, earnings as of 3/31/2021).

My employer will not amend my W-2, but if I enter my earnings as of 3/31/2021 in Box 18 of the Turbotax W-2, it changes the 360.1 Line 1, Column B to the correct amount of wages for New City Resident Period and we receive a considerable refund.

I know I should not enter an amount in Turbotax that is is different than my actual W-2.

In the NYS input section follow the steps below

NY Residency-enter part year

confirm NY address

email

county, which would be NYC..then district

date of last move..also check off that you received income from NY while Non-resident

make the NY income allocation

there will be a W-2 summary to edit the form
