topic Illinois not refunding taxes despite no connection to the state in State tax filing

One of my W-2 forms for 2021 specified Illinois as the state, which is outdated information.

I did not live or work in Illinois in 2021, and the company has no offices, operations, or other business in Illinois.

So, I filed a tax return with Illinois as a non-resident.

I received a Return Correction Notice from Illinois which, without proof or reason, changed the income source back to Illinois.

The Return Correction Notice requires a statement from the employer on their letterhead verifying my Illinois income, but I don't have any Illinois income, and the company is currently no longer operational.

My guess would be that there is a high chance now that Illinois will just get to keep the taxes?

I think this is worth another reply to the state.

I would reply that the company is no longer in business, therefore I cannot get a statement from the employer much less on their letterhead nor can I get the defunct employer to verify any Illinois source income.

I would encourage the state of Illinois to check their own tax records to see if the company is still in operation; if it is not, then you (the state) will understand my reply.

Be nice but firm. Remember that the people in state offices like to reply with standardized pre-printed forms, so you have to be firm to get them to actually read what you said.

Then, at the end, nicely ask them to reverse the income back to your original filing.

Sorry to inform you, but Illinois is not going to do anything until they receive a corrected W-2.

The W-2 is all the information they have to go on. That is why they sent you a letter reversing what you stated.

Writing a letter and/or explaining that it is an error will be in vain until they have a corrected W-2.

This is the employers responsibility. Since you indicated that the company is no longer around, I believe you will be out the $$ involved.
