First----you cannot file a joint return without your spouse agreeing to it. So forget that.

What do you have----do you have a SSN? (It will be on a past joint tax return if you filed a joint return last year) Date of birth?

Are you in a community property state? If not, you do not need her income information to file MFS.

(AZ, CA, ID, LA, NV, NM, TX, WA, WI)

Are you trying to file married filing separately? You can do that......and file by mail. On the top of the Form 1040 hand write that your spouse's information is not available.

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Federal and state returns must be in separate envelopes and they are mailed to different addresses. Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

If you are legally married then you can file as Married Filing Separately. You only need to enter her name and Social Security number, nothing else concerning her would be needed to entered on the tax return.
