My taxes have already gone through and been accept it. And I was waiting on my stimulus check which should have been here on the 15th. I just recently got a note in the mail stating that they took my husband's portion my portion and my three children's portion to pay some of his back child support. says I need to file an IRS form 83-79 injured spouse claim and allocation. If I paid for TurboTax to do my taxes can they also fill out this form for me and get it turned in?

Form 8379 lets you (the "injured spouse") get back your portion of a jointly-filed refund if it's seized or offset to pay your spouse's debt.

You must file jointly to use this form. Filing an 8379 will delay your federal refund by up to 14 weeks.

To file this form in TurboTax:

Open or continue your return.

In the search box, enter injured spouse and then select the Jump to link in the search results.

Answer Yes to Do you want to claim innocent or injured spouse relief? and carefully follow the onscreen instructions.

Note: Pay close attention to the screens, as some of them apply to innocent spouse relief, which is different. Leave those questions blank if you only want to claim injured spouse relief.

This article will guide you through the process.

Do I have to ammend my taxes or just fill out the Injured Spousal form and send it? Through Turbo tax it will only let me file the form if I ammend the taxes.

I went a printed off the form but don't know who to mail it too or fax it too?

If you did NOT send a form 8379 WITH the tax return then you need to mail it in now by itself ... the injured spouse signs it and mails it to the correct address depending on where you live... pick your state and use the FORM 1040 NO PAYMENT column ...

https://www.irs.gov/filing/where-to-file-paper-tax-returns-with-or-without-a-payment
