&lt;P&gt;The IRS does not allow illegal operations or treatments to be deductible on a Federal tax return. Marijuana is still illegal under federal law, a Schedule 1 drug.&lt;/P&gt;

&lt;P&gt;&amp;nbsp;&lt;/P&gt;

&lt;P&gt;So what about a state tax return? It is an interesting question. I do not know what state you live in, but my advice here would be that unless you can find a specific mention for marijuana as deductible under the state tax code, I would avoid it. Yes, marijuana is legal in many states, but it is still illegal on the Federal level. Taking it as a deduction on a state return would be quite risky, with the potential to subject you to penalties and interest for inaccurately filing your returns.&lt;/P&gt;

 &lt;LI&gt;Scroll down until you get to &lt;STRONG&gt;Medical&lt;/STRONG&gt;, click on &lt;STRONG&gt;Show More&lt;/STRONG&gt;.&lt;/LI&gt;
 &lt;LI&gt;Click on &lt;STRONG&gt;Medical Expenses&lt;/STRONG&gt;&lt;/LI&gt;
&lt;/UL&gt;
