I filed after due to not noticing the offset on my taxes. Have never had one or dealt with this before but a student loan my wife took out when she was 19 I guess caught up with her 7 years laters. So from what I have read up on yes ypu should be getting it direct deposited. Finally after waiting over 2 1/2 months I called them on June 17 just to find out it had been recieved and assigned to someone and if I don't recieve anything in the mail in 30 days to call back. Then on July 12 I got a letter (dated July 10th) stating how much I was getting back and that I should have my refund in a couple of weeks.
When I think a couple of weeks I think 2 weeks but what I'm reading for all your comments that its actually 4-6 weeks? I gave them the first 12 weeks before I started calling even though I electronically filed. Called again today to find out they just reassigned me to a new auditor. And are saying it could take up to 45 days to approve or disapprove my claim. I have had my state check for over 3 weeks. Usually I owe and they make sure to put my check through the bank within 2 or 3 days. I surely hope they're going to be paying me interest for the time they've been using my money. I was a little worried . This is the first time this had happened to us but what is weird is that on the child support page it shows the payment was paid out so I m curious if she then has to pay it back or how that whole process works . And if everyone is around the 21 weeks time frame , I prob won’t hear back until mid September . I am also the bread winner and I m hopefully I ll get the entire refund because on the In injured spouse form I used the one from turbo tax and it split the deductions 50%.
Fri, 16 Aug 2019 01:23:48 GMT https://ttlc.intuit.com/community/after-you-file/discussion/re-still-waiting-for-our-tax-return-filed-injured-spouse-on-feb-14-when-can-we-expect-the-return/01/841701#M187305 Mia2 2019-08-16T01:23:48Z Re: Still waiting for our tax return , filed injured spouse on Feb. 14.

So I'm sure everyone that's been waiting on an IS claim since march will get the same answer probably huh? I haven't received any kind of response since sending the IS form out after being offset and can't find anything on how the process even goes, like if you're an IS there shouldn't be any other issues besides them being behind right? Do you get a letter beforehand or just wait and see..

We are still waiting as well. Called the IRS and after days of trying to get through, I finally reached someome and she informed us that the Injured Spouse department is behind and getting refunds out as fast as possible. We have been waiting 15 weeks now.

I am also waiting on my refund... I waited 30 days called and they made a "note" for the injured spouse dept. I waited another 30 days and they sent them a "memo", now finally I got a letter of approval for said amount and they said it could take up to 3 weeks to receive my check. Going on the 4th week now I called and the irs said it could take up to 30 days after receiving that letter for me to receive my check... Lol.

Same here!! Going on 17 weeks for me! This is is my third time filing taxes for my husband and myself w/the 8379 and I’m shocked it’s taking this long. Our state tax refund was done within a few weeks! Good to know I’m not alone in this. I keep checking the website....it always says received and “processing”🤦‍
My hubby tries calling them and could not get through to a real live person. This is awful!

This is beyond ridiculous. I filed mine in April and had to call because it was past the 11 weeks. If they are backed up...they need to hire more people temporarily. Is there anyway to escalate these issues?

I filed mine together in April also. Called last week and they said my official 11 weeks were on Monday. Called Monday and they said nobody touched it so they extended 30 days. So now I have to wait 27 days to call them again

This is what I had to do. I filed my at the end of Feb. I called 30 days after filing they said noone had touched it yet and they put a "note" called 30 days later and noone still had touched it so they sent a "memo". Finally 30 days later I called again and it was being processed. A week later I got a letter stating that I would receive my check aslong as there were no other offsets. On my fourth week now and nothing. I have called 2xs last week to figure out if my check was comming and the IRS agent just told me it is still being processed. 2nd time I called the IRS agent said it was still being processed that they would send me to the Injured Spouse Claim dept. They transferred my call and although I had already waited 40 minutes on the phone to talk to an IRS agent I waited 20 more after being transferred then I hung up due to lack of patience waiting on the phone for that long... Lol. Crossing my fingers hoping that I get it this week even though the week is almost over with.

I will try escalating to congressional office. I already called the IRS and they put a so called memo for them to take action within 30 days. What a joke. If someone was holding up their money, they wouldn't be happy either. Last year I got mine in six weeks. The rep told me they were backed up from the shutdown. Bunch of excuses and still unacceptable.

I got a letter of approval a month ago. I called today again and they said they had to make 3 adjustments that it is on it's way to me. They said they will pay any interest for waiting so long aswell. After getting approved the lady said it takes around 4-6 weeks that on the 5th week is when most people get it so around August 1rst or 2nd I should recieve my check and I filed at the end of feb for my inj spouse claim lol. Atleast it finally is getting done.

And that was talking directly to an injured spouse form specialist. So after you are approved or you find out expect anywhere from 4-6 weeks before getting tyour refund or calling to see what the hold up is.

I am a bit confused. When I filed originally I filed for direct deposit. Will the injured spouse force it to be a check? Or will I still get my direct deposit like I put when I filed my taxes and injured spouse together?

As far as I know you should get it direct deposited if that is what you requested when filing the form with your taxes. I filed after due to not noticing the offset on my taxes. Have never had one or dealt with this before but a student loan my wife took out when she was 19 I guess caught up with her 7 years laters. So from what I have read up on yes ypu should be getting it direct deposited.

I have, I am getting my check at around the end of this month. I have had to call and bug them numerous times. I filed mine at the end of Feb. So the process takes a very long time. Just keep calling and bugging them.

I file my injured spouse form on March 31st.

Yes, that would be correct. When I talked to the injured spouse specialist directly she stated that it is recommend waiting between 4-6 weeks before calling back to see where the money might be if not received yet. She said that typically 90% of people receive their refund 5 weeks after receiving the approval letter.

Same here! Still waiting on our injured spouse tax return. Filed in beginning of April and called and had a memo added and a supposed phone call within 30 days? Still no phone call. How do I contact the congressional office?

I did a Google search for the Congress representative for my district. You can find that based on your address online. They did end up referring me to a state representative, but, they were super helpful. granted, I still have not heard anything about my return. But, I feel like this is the quickest way to try to get an answer. That would be a good starting place. Good luck! I know how frustrating this all is.

I'm in the same boat! So did you receive your state taxes shortly after you filed a injured spouse form? Would it be direct deposited into my bank account the same as my federal after I filed an injured spouse form? I filed mine the first week of March. Still no word.

I also sent out the IS form early march and after sitting on hold and hanging up multiple times I just gave up once I posted on here and seen that people were being told they were backed up and to wait 30 days etc but have yet to receive anything in the mail about my return so I tirelessly searched and found a different number with an extension and called just after 7am today and the wait time was only 2-4 minutes thank God but she said they had no record of our IS form and to send it to the Fresno office even though the instructions say to send it to your local office but she said that there is no processing office in Ohio so idk what happened but we've been waiting since march for absolutely nothing smh
I found the number on a different site because they keep deleting them on here when you post one that's not the main one but hopefully it gets by and everyone can get through as quickly as I did.. She said that theres four call centers with 400 people taking calls all day but that as soon as California comes online at 9am its Basically impossible to get through anything short of an hour so call early lol all of their numbers start out the same way but this one ends with OhFive8Too and when it says if you were given an x tension enter ()Siiixxx5Tooooo() lemme know if that works and if it's still somehow deleteedddd give me your email and I'll hook you up lol

Hi there,
Same exact situation for us. If you create an account on the irs website you can find your transcripts. I logged in and found out my husband is getting his injured spouse back and when it was issued. Hope this helps! (Also it does look like he will be getting interest according to the transcript!)

I have been waiting over 18 weeks.

The file date is listed as April 15th even though we filed it before then. It says on the transcript that’s the date they count from (which was annoying but made the sense with the timeline) The transcript is the best way to see where you are in the process because it gets updated any time someone opens the account to work on it. Hope this helps! We received our check in the mail 3 days after the transcript listed refund issued. It also included interest.

The same thing happened for us. They deposited our check immediately. We also filed in February but on the transcript it says they count from April 15th no matter when you submitted it. Hope this helps!

I filed my injured spouse return electronically with the 8379 form on April 15th i.was accepted by the end of the day on April 15th .it is now August 8th and we are still waiting and have not heard anything at all! No approval. No denial. I check our transcript online every single day because that will be the first thing to have changes..onc I see a change on the transcript then I will begin to check Santa Barbara tax products website because it will show once they receive any money from the IRS then it will take a few days maybe a week for Santa Barbara tax products to deposit the money into my account that is the bank that TurboTax uses...their website is very simple ..you put in your social security number then the expected refund amount then you're filing category such as married filing jointly married filing separately etc.

I just received my refund yesterday after 21 long weeks. Thank God I was one of the lucky ones not needing the money immediately as my children are all grown and due to a recent job change, I had almost all my debt paid off. It was the fact that my spouse earned absolutely no income for the year I solely provided for my family and yet they took that long to process my claim.

Yes about a week ago, with interest but filed at the end of March..I would start calling every other day...Thank God I was not in need of the money as many people here were. I felt so much sympathy for those waiting and in such dire need of it..It was ridiculous the amount of time it took this year...

Mia, ours was for child support also..my husband owed like 1200 the child is 25.. when he got hurt and couldn't work I agreed to take out a 4000 college loan in exchange for the Ex stopping the support.. Needless to say the state did a crappy job of keeping up with the order..anyway I was able to get it straightened out but it took 21 weeks and that's the average for everyone it seems..I called every other day to let them know I was waiting the last couple of weeks...it was hilarious because I really didn't need the money and after interest and me being the bread winner the state got 128.. and had to refund it with interest

We filed taxes in March 2019, got notification refund would be offset due to husband's past support on his kids which I completely forgot about. Mailed out injured spouse paperwork April 23, 2019...it's August 15, 2019 and have called 3 times and still nothing new to report. But boy if we owed them money it would be taken immediately.

I filed everything at once because the state notified my husband and we fought it..The child is 25..and He has 24000. In college loan debt for her and her sister..it amazes me how bad the system treats the Fathers..If the mother was injured or had job loss she would get state everything and reduced child support owed..But my understanding was it could take up to 12 more weeks from the time the amended return is filed

Thanks !

25 weeks and counting here. We've now passed the "give us 30 days for refund or request for information" mark and I'm currently on the phone with the IRS 25+ minutes and counting...

Hi! Google the number for the taxpayer advocates office. Tell them the delay has caused financial hardships and they have to instruct the IRS to expedite your return. It worked for us. We got the check 2 weeks later. Good luck!

It is 22 weeks and I was told that if I don't see a date by September 12 to call the office. This is so wrong especially since the state have been paid what I owe them.

It is September 13 at7:55 am I filed mine in April. Called October 22 was told to call on Sept 13. Called Sept 13 was folded that someone started and haven't finished a memo is being sent to them. Give 30 days and if I don't see a date or get a letter by Oct 13 call back Oct 14. My husband is on a payment plan and every month the balance is the same. This is BS. I had to pay state taxes and they cashed my check in 1 week. They sent me a letter thought I hadn't paid and 200 interest was attached. When they found out that I paid, no apology just said disregard. Please respond. I will keep you updated. Has anyone gotten their refund? Let me know how long it took.

We filed our taxes on Feb 6th also filing injured spouse last year we received it on week 8. This year I contacted a IRS tax advocate who stated unless you have a hardship right now it's taking upwards of at least 16 weeks. We do have a qualifying hardship so I emailed it to her and and she got the ball rolling. Call your local IRS Advocates office or the main number 1-877-777-4778. Someone should be able to check on it for you. We are so grateful for the advocate office. Good Luck
