It is illegal tax wise to loan a social or a child as a dependant to anyone that is not taking care of the child. However, if your ex and you cant agree to let you claim your child and you claim your child; then you will be getting your ex and her parents and possibly yourself (if you cant prove the time you claimed the child lived with you), in a great deal of trouble.

Hello, I live in California. Me and my ex share our child but the child spends most of the year with her mother. She has never filed taxes and lives with her boyfriend. I asked to file my child as a dependent this year but she lends the social to her parents even though they no longer live them. Am I still able to claim the child since someone who is not a parent is claiming our child and does not live with them either?
