No, legal fees are no longer deductible since the Tax Cuts & Jobs Act of 2017.

Depending on your state, it may be deductible for your state itemized deductions.

I don't itemize but may in the future.

Previously our tax person used to use tax prep fees (portion of) under our rental.

We aren't renting the property currently so not filing that form.

However, I noticed in a very basic Turbo Tax filing that Tax preparation is listed in the itemized deduction area.

Question: is Tax preparation Not considered a Legal Fee?

Is your answer a blanket statement... That NO legal Fees are Deductible? or are there nuances.

Please explain in depth. (I am getting educated for future years)

The answer is strictly for the personal portion of the tax return and itemized deductions. Estate planning legal fees would not be an allowable deduction.

Tax preparation fees are no longer a deductible expense for the itemized deductions on the federal return due to the Tax Cuts and Jobs Act (TCJA), which is in effect until 2026. As far as business returns or rental activities a portion of the tax preparation fees that would be attributable to that portion of the return can be deducted on that part of the expenses for those activities. (Schedule C or Schedule E).
