My husband is a veteran and receiving a 100% total and permanent disability benefits from the VA. This is mental disability. My question when it comes to childcare tax credits (when both parents need to work to receive credits for daycare and such) do I mark him as a disable or unemployed? Also do I file jointly or head of household and claim him as a dependent

In the dependent care credit interview you will mark your spouse as disabled and select the number of months in the tax year that he was disabled and unable to care for himself. That will eliminate the requirement for both spouses to work requirement.

So, to mark him as a disable although he doesn't have disability thru the state just thru the VA?. Also still file jointly.
