I am the court appointed representative for my mother who passed away in 2021. I previously notified the IRS using form 56 and supplied the court papers. TurboTax provides the message below regardless of whether I fill out a 1310 or do not. I do answer the question as to whether the IRS has previously been notified with 'Yes'.

"IRS Rules Don't Allow E-filing of your Federal Return"

and then tells me to do a 1310.

I realize I can print and send it, but it's not what I purchased the product for. My understanding is that the IRS does allow e-filing for a deceased person.

You may be getting the message about not being allowed to e-file the return due to another issue. Both decedent's returns and Form 1310 may be electronically filed.

Take a look at the following TurboTax article for more information about when a return cannot be electronically filed:

When a tax return can't be e-filed no matter what you do

It looks like the only thing that would apply here is "Contain non-final form'. When I print form 1310 it has a watermark of "Do Not File Form not Final'

Is there any way of knowing when this form will be finalized?

Form 1310 is currently scheduled for this week's release on Thursday, 02/24/2022.

https://ttlc.intuit.com/community/forms/help/irs-forms-availability-table-for-turbotax-individual-personal-tax-products/00/26224

Progress - The 1310 now shows up without a watermark. I deleted the old one and filled out a new one. Now when TT does the Federal Review it tells me that the return cannot be e-filed because form 1310 must be completed.

Form 1310 cannot be e-filed. You can prepare the form and then mail it in to the same IRS Service Center as the decedent's tax return would be mailed to. You would complete the form as their personal representative.

Please see the Form and instructions in link below:

Did something change? It's always been my understanding that when a 1310 is involved, the IRS wants an original hard copy with an original signature on it. Can't do that with e-file.

I am not certain whether the form can be e-filed with TurboTax, but it can be e-filed with other software (professional) if the entries meet the IRS guidelines for e-filing the form.
