Should i choose the US citizen or legal resident or resident of Canada or Mexico in the citizenship question. Thank you,&lt;/P&gt;</description>

      <description>&lt;P&gt;There is no place on the return to indicate your residency status. If you are a resident alien, you would just complete the return and file it just as you would if you were a citizen.&lt;/P&gt;</description>

      <description>&lt;P&gt;It depends. If 2021 was the first year your son came to live in the US then he likely would be a citizen of Canada, not the US.&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;&lt;/P&gt; 
&lt;P&gt;&amp;nbsp;If your son is a citizen of Canada and does not pass the &lt;A href="https://www.irs.gov/individuals/international-taxpayers/us-tax-residency-green-card-test" target="_blank"&gt;Green Card Test&lt;/A&gt; or &lt;A href="https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test" target="_blank"&gt;Substantial Presence Test&lt;/A&gt;, then you would choose legal resident of Canada.&amp;nbsp; If your son does pass either of these tests, then he could be considered a US Resident for tax purposes.&amp;nbsp;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Thank you Vanessa, he was in the US for the whole 2021 year but he does not have a SSN or ITIN. We applied for adjustment of status and he should receive his EAD and then his SSN very soon. So I should choose "legal resident" for his Citizenship status, correct?&lt;/P&gt;</description>

      <description>&lt;P&gt;Yes, he would be considered a legal resident as long as he meets either of the tests as provided by our awesome Tax Expert &lt;a href="https://ttlc.intuit.com/community/user/viewprofilepage/user-id/644004"&gt;@Vanessa A&lt;/a&gt;.&amp;nbsp; You should consider holding off on filing until he gets his social security number (SSN) since it should be soon, but not later than April 18th, 2022.&amp;nbsp; If you need to file before the SSN is received, you can write 'Applied For' in that spot.&lt;/P&gt;
