No, since you are claiming the dependent this year you are entitled to the Child Tax Credit. You will enter your dependent and go through the Child Tax Credit calculation. When you get to the Advance Child Tax Credit question regarding Letter 6149, you will enter that you received $0 for the payments.

The other parent will have to enter the information regarding the payments they received on their own tax return.

For more information on how to do this see How do I enter my advance Child Tax Credit payments in TurboTax?

the other parent will have to pay back the credits when there is no dependent on their 2021 tax return to support the credits.

The other parent will have to repay the advance child tax credit if they do not qualify for repayment protection.

The IRS says:

You won’t qualify for any repayment protection if your modified adjusted gross income (AGI) is at or above the following amount based on the filing status on your 2021 tax return:

$120,000 if you are married and filing a joint return or if filing as a qualifying widow or widower;

$100,000 if you are filing as head of household; and

$80,000 if you are a single filer or are married and filing a separate return.

For information on the definition of modified AGI, see Topic C: Calculation of the 2021 Child Tax Credit.
