&lt;P&gt;If you are not actually legally married then that is tax fraud - a Federal Felony.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Also, Head of Household REQUIRES that the dependent be *related* by blood or marriage (son in law,etc) - that would also be tax fraud.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;You can only mail file and your BF can expect a letter form the IRS.&amp;nbsp;&amp;nbsp; He needs to AMEND &lt;STRONG&gt;BEFORE&lt;/STRONG&gt; the May 17 due date and change his filing status to single or he could be in deep trouble.&lt;/P&gt;</description>

      <description>&lt;P&gt;Not quite sure what your BF is up to.&amp;nbsp; &amp;nbsp;You cannot file a joint return unless you are legally married.&amp;nbsp; Is he legally married to someone ELSE that he filed a joint return with?&amp;nbsp; &amp;nbsp;He cannot file a joint return with you since you are not married.&amp;nbsp; &amp;nbsp;&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;And he cannot claim you as a qualifying dependent to file as Head of Household either.&amp;nbsp; He cannot use a GF to file as HOH.&amp;nbsp; He needs his own blood-related qualified dependent in order to file as HOH.&amp;nbsp; Does he have a child that he is claiming, for instance?&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;And....not sure what you are trying to do either.&amp;nbsp; &amp;nbsp;Did you have income of your own in 2020?&amp;nbsp; &amp;nbsp;If you had over $4300 of your own income in 2020 (not counting Social Security) then you cannot be claimed as anyone else's dependent.&amp;nbsp; &amp;nbsp;If you did not have any income then it is possible for you to be claimed as someone else's dependent if you lived with them the whole year and they paid for over half your support.&amp;nbsp; &amp;nbsp;If you CAN be claimed as someone else's dependent then you are required to say on your own tax return that you can be claimed as someone's dependent.&amp;nbsp; If you can be claimed as a dependent you are not eligible to receive a stimulus check.&amp;nbsp; The person who can claim you gets the $1400 check.&lt;/P&gt;
