I recently notified the IRS that I did not receive a 1099R for a direct rollover from a litigation class action suit. They sent out a request to send me one, but I will not be receiving anything from them. I am trying to fill out a Substitue 1099R in Turbo Tax and it is telling me that I need to provide a Payer's Federal Identification Number. How do I get passed this error if I do not have one and Form 4852 states only if known?

Also is there a way to upload supporting documentation into Turbo Tax to support Form 4852?

Did you receive the money and deposit it into the retirement account. How was it reported to you?

If the money was deposited into your retirement account directly as in internal transaction then a 1099-R would not be necessary.

1099-R's report distributions from your account, not money to your account. It would not be a rollover if you do not remove the money and then return it.

Settlements payable to your retirement account should just be given to the account trustee to be deposed into the account. Nothing need be reported by you.

This settlement came from an old 401k plan I no longer have pertaining to a class action suit on how some of the funds were being handled. Upon settlement, a check was issued and directly rolled over into my current plan (different plan). I never touched the money. According to the IRS this does need to be reported and as such they instructed me to fill out a Form 4852. In Turbo Tax, you can't just fill out this form. You have to fill out a 1099-R form, then jump to the Form 4852. This is where I run into issues as it is requiring a Payer's Federal ID number.

The gentlemen at the IRS mentioned to attach a copy of the check or other supporting documentation to show how I came up with the amount that needs to be reported. I cannot find anywhere in Turbo Tax that I can do that.

On the 1099-R page there is a button for a substitute 1099-R, but it does require the payers TIN. Contact the payer and ask for their TIN.

If you cannot get it then you will not be able to e-file, leave it blank and print the return and write "Unknown" in place of it and mail the return to the IRS.

Thank you. It does not make sense that you have to fill out a 1099R when you actually send in Form 4852 which is the substitute form when a 1099R is not sent nor will it be issued. On Form 4852 it states the Employer's or Payer's identification number is required only if known. I would hope Turbo Tax would recognize that there might be some information you might not be able to provide and still let you efile. That's one of the reasons why I purchase the software.

Try and see.

The TurboTax substitute 1099-R is not the actual 4852 form, it is just a data entry screen.

That is correct, but it doesn't look like I can bypass the 1099R portion and just jump to the Form 4852. Maybe I am missing something.

It was reported to me on a 1099-R. I had an ERP I had to sign to let it rollover from the 401K I had under my formal employer and it was directly deposited into a traditional IRA.

If you received a Form 1099-R and it was from a direct rollover from your 401(k) to an IRA, then there should be a code G in box 7. If so, simply enter your form and TurboTax will know it is tax free. A Form 4852, substitute for your 1099-R is not required. Likewise if you did not receive a Form 1099-R because it was a direct trustee to trustee transfer then there is nothing to report on your tax return.
