      <description>&lt;P&gt;If legally married the filing status on the tax return can only be Married Filing Jointly or Married Filing Separately.&amp;nbsp; Since you do not have a Social Security number or an ITIN issued by the IRS and assuming that the tax return will not be filed with an ITIN application, Form W-7, the return can only be filed as Married Filing Separately &lt;STRONG&gt;NOT&lt;/STRONG&gt; as Single.&lt;/P&gt;

&lt;P&gt;No, there are no consequences for either of you.&amp;nbsp; As a US citizen or US resident he is required to file a federal tax return each tax year if his income meets the minimum filing requirements.&amp;nbsp; He would continue to file as Married Filing Separately if you do not have a SS number or ITIN issued by the IRS.&lt;/P&gt;
&lt;P&gt;If his income does not meet the minimum requirements then no federal tax return needs to be filed.&lt;/P&gt;</description>

He mailed the form 1040 within the daedline as discussed with you but never received the first nor second stimulus check. Can he claim a recovery rebate credit by filing a 2020 form 2020.
