Yes, in order to have the program recognize the overpayment, each W-2 would need it's own individual EIN. You will need to ask your employer(s) to give you a corrected one.

IRS Rev. Proc. 2013-39

says you can have 2 different employers using same EIN if one is an “Agent” for the others. One of the W2 says “agent for XXX” but both have same EIN. These W2s are correct. TurboTax needs to allow this as 2 different employers so that the IRS refunds Money directly to the filer. The employer is not responsible for this. How do I get TurboTax to fix this? In previous versions would ask if these were different employers and do this automatically. Now that option doesn’t exist.

My wife has this exact situation as well...

However, I was able to get both W-2s into TurboTax even though they had the same EIN, but it tells me that she overpaid Social Security and she needs to get a W-2c from her employer and we shouldn't file without a corrected W-2c.

Under the "What if my employer won't give me a W-2c?", it states that I need to contact 1-800-TAX-1040 and the IRS will contact your employer to request it.

Under the "How much should my employer withhold?", it states that we can file IRS Form 843, Claim for Refund and Request for Abatement. This is a separate form that you can get from the IRS site and it should not be included with your tax return.

This is just all awkward and it is unclear whether I should proceed to file or not...

I presume I should do the following:

1. Have her request a W-2c from her employer

2. If the employer won't provide a W-2c, call 1-800-TAX-1040

3. If that doesn't generate a W-2c in time, just file what I have and then submit form IRS Form 843

(Opinion) Sorry, but a W-2C is not appropriate, they (the pay agent) won't change it ..and it won't help you if the reason for the EIN being the same, because the same pay agent was used.

I know you can correct the issue when using the "Desktop/Download " software...by using Forms Mode to enter the SS overpayment on the Schedule 3 worksheet.

__________

Right now I don't recall how to fix the "Same Agent EIN" with the "Online" software.

Perhaps someone else does.
