&lt;P&gt;&lt;SPAN style="font-size:14.0pt"&gt;&lt;SPAN style="font-family:Calibri"&gt;Form 8379&lt;STRONG&gt;&lt;EM&gt; is filed by one spouse&lt;/EM&gt;&lt;/STRONG&gt; (the injured spouse) &lt;STRONG&gt;&lt;EM&gt;on a jointly filed tax return&lt;/EM&gt;&lt;/STRONG&gt; when the joint overpayment was (or is expected to be) applied (offset) to a past-due obligation of the other spouse.&lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;

&lt;P&gt;&lt;SPAN style="font-size:14.0pt"&gt;&lt;SPAN style="font-family:Calibri"&gt;I'm not personally aware of anyone needing to file Form 8379 when &lt;EM&gt;not&lt;/EM&gt; filing a joint return.&lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;

&lt;P&gt;&lt;SPAN style="font-size:14.0pt"&gt;&lt;SPAN style="font-family:Calibri"&gt;That said… I suspect that Turbo Tax won't let you e-file Form 8379&lt;EM&gt; unless&lt;/EM&gt; you're filing a joint return, because of the IRS rule I cite above.&amp;nbsp; &lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;

&lt;P&gt;&lt;SPAN style="font-size:14.0pt"&gt;&lt;SPAN style="font-family:Calibri"&gt;So, if your contact at the IRS can confirm what they've told you, or you can't get confirmation, I'd suggest that you complete your non-joint tax return in TurboTax, and print it out to mail.&amp;nbsp; Then, print Form 8379 from &lt;A href="https://www.irs.gov/pub/irs-pdf/f8379.pdf" target="_blank"&gt;&lt;STRONG&gt;&lt;EM&gt;this link&lt;/EM&gt;&lt;/STRONG&gt;&lt;/A&gt;, complete it by hand, and mail it with your completed return.&amp;nbsp; I'd also suggest including a letter with your return, explaining what you were told by the IRS about filing Form 8379 with a non-joint return.&lt;/SPAN&gt;&lt;/SPAN&gt;&lt;/P&gt;</description>
