No, as I am still in process of receiving my permanent residency. I pay my taxes using an ITIN. Employer is taking out 4% of every paycheck.

So I months ago, I received a 1099 misc from an employer. I am a full time employee, I get money taken out every paycheck. When I received the 1099 the box where it says “federal income tax withheld” is blank. So I’m assuming meaning zero money taken out when in deed I have my pay check stubs that say how much is taken out. I still haven’t filed because it’s obviously not correct. I brought it up to employer and he basically said everybody’s was done wrong and we would get new ones. I still haven’t received anything and its very frustrating. I just want to know where is the money that was taken out of everybody’s paycheck. It is possible that something fraudulent could be going on?

On your paystub, is there Social Security taxes and Medicare taxes being withheld? If so, then you are an employee who should be receiving a W-2, not a Form 1099-MISC.

A Form 1099-MISC is issued to independent contractors only and they are required to pay Self-Employment taxes that cover both the employer's and employee's portion of Social Security and Medicare taxes on their net profits.

Contact the IRS since you have not received your W-2 as required on or before January 31, 2019 for tax year 2018.

Go to this IRS website for information - https://www.irs.gov/taxtopics/tc154

If the employer is withholding federal income taxes from your wages then they are required to provide you with a statement showing the total amount of wages received and the total amount of federal taxes withheld for tax year 2018. That statement would be a Form 1099-MISC if you are not an employee but an independent contractor.
