I finally called on the 60th day and they said they don't have any record of my wages from my old employer, only the 3k I made in the end of the year with my new employer. I told them I had the W2 to prove it but the IRS agent said that wasn't good enough, the employer needed to confirm my wages. The IRS agent sent a referral and said it would take another 60 days! I filed Feb.1st, it is now May 15th, I can't wait any longer. I called my previous employer and she swears she sent my info in. The IRS is saying they never got their copy. More importantly, they're saying they didn't get the taxes your employer withheld from your pay (boxes 2,4 & 6).

They now need to decide whether to go after you or your employer for the money. Give them what proof you have. Pay stubs, particularly year end, would be helpful. As the answer above indicates, the IRS has probably already contacted your employer. This may take a long time. Cash strapped employers not sending in the money is a common problem Fri, 07 Jun 2019 22:19:10 GMT https://ttlc.intuit.com/community/taxes/discussion/every-tax-document-w-2-1099-etc-is-sent-to-both-you-an/01/762243#M305007 Hal_Al 2019-06-07T22:19:10Z UPDATE: I spoke with my old employer, she double checked... https://ttlc.intuit.com/community/taxes/discussion/update-i-spoke-with-my-old-employer-she-double-checked/01/762250#M305010 UPDATE: I spoke with my old employer, she double checked her work and confirmed she did send my W2 to the IRS. (I believe her because there wasn't any problem last year and all the other employees already received their refunds, I am the only one who didn't.) I told her the IRS agent had told me that once the employer confirms my wages I could get my refund. She said she would try to contact them today. So my question is this...Will the IRS allow the employer to proactively confirm my W2 over the phone? Or do I still have to wait 60 more days for them to do the job they failed to do the last 60 days? I have been waiting for my return since mid February. I feel like I’ve been given the runaround, finally today, the IRS told me they were waiting to verify my income...that they show no income at all for me. I went directly to my employer who says it was submitted by the deadline (which I believe) and that he has not been contacted by the IRS (which I believe). My employer will not contact the IRS unless contacted, and seems to think that I am a victim of some sort of scam. When I called the IRS back to ask if they have attempted to contact my employer, they were unable to give me that information or refer me to anyone who could. I was also told that if it’s not resolved within the 60 days allotted, it’ll go on another 60 days and if the income is not verified they will change my return to reflect that I didn’t earn any money at all! I tried to contact a tax advocate, and am waiting to see if they can help me in any way. Heck, the IRS even provides the blank form for doing exactly that on their own website!

The employer is required to send in IRS Form 940 to the IRS every year. (https://www.irs.gov/pub/irs-pdf/f940.pdf)

This form includes all quarterly tax submissions for the tax year, along with the total of all wages paid to all employees. If mailed, it also includes a copy of all W-2's. It very well could be that the employer did not include your W-2 in the envelope, or the IRS employee who opened the envelope didn't see it fall out into the trashcan next to their desk. Therefore, the numbers on the 940 do not agree with the total of all the W-2's received.

Until this gets straightened out between your employer and the IRS, there is absolutely nothing you can do but wait. About the only benefit you will see out of it, is that if you have a refund due, the IRS has to pay you interest on that refund amount not yet paid to you, if they don't pay you by July 15th, or 45 days after they receive your return - whichever is later. See https://www.irs.gov/businesses/small-businesses-self-employed/interest-for-individuals and pay attention to the information in the right side column.

Tue, 07 Jul 2020 01:05:52 GMT https://ttlc.intuit.com/community/taxes/discussion/re-i-have-a-w2-why-isn-t-that-enough/01/1660656#M588885 Carl 2020-07-07T01:05:52Z Re: IRS Claims my former employer didn't report my wages but I have my W2 and I spoke with my previous employer who says she sent everything in. Mine ended up everything was ok but they were having trouble verifying my identity of all things employer did send everything fine you cannot resend any forms or you will end up submitting tax return twice and be in big trouble if you do they will audit you and worse things mine took 7 months till I got my money due to the fact that the social security admin somehow had a typo and finally aft er r calling 6 times to speak with 6 different people I finally found my birth month was wrong in the system instead of month 10 they had same day same year but month 11 wow and it's a big deal to update this I still haven't been able to get it fixed they want your original paper copy of birth certificate no duplicates or copies and they wanted me to send my actual driver license to them by mail I said heck no what if I get pulled over and what if they lose my license in the mail and my birth certificate I only have my certified copy they won't take that which is so wrong anyways the IRS hwld my money with no update no matter how many times I called they told me to contact my local governor yeah that's right to see if he could help . Called my tax rep and chewed him out and demand he recheck my tax forms he submitted yes I did not use turbo tax and it's a good thing to only cost me 50 bucks for a digital tax return and everything was good .so the IRS said they have 3 years to send you money yes 3 years and even then you have to send an amended tax form it's a mess .they finally sent me my money but still gave me no real reason last year I had my money in 2 weeks .super fast this year like 6 or 7 months I was furious and it was alot of money and I was broke 🤨hope this helps there's not much you can do but wait for a letter that's really says nothing and call everyday till you get the answer you want from the irs .
IRS took all 60 days to review my account and never once contacted me. I didn't have any problems last year and I am the only employee experiencing this problem. Sounds like there was an error on the IRS side. I don't know what to do at this point. Any thoughts?

Ok ...the IRS will now ask the employer for the records hence the 60 day extension. So ask the employer to respond to the IRS when contacted even if she did file the W-2 & W-3 & 1096 timely. If she did NOT do it electronically then the paper forms had to be entered manually and when humans are involved mistakes can be made. I had a client with this situation last year where only their W-2 form had an IRS issue out of 8 total employees and the employer mailed in the forms .... bottom line it took 8 months for the employer & IRS to get this corrected.

What you could do ? First talk to the employer. Talk to the IRS and see where the employer can send the supporting docs in advance of being contacted.

Every tax document (W-2, 1099 etc) is sent to both you and the IRS.

Cash strapped employers not sending in the money is a common problem

UPDATE: I spoke with my old employer, she double checked her work and confirmed she did send my W2 to the IRS.

Ask them ... no one in this forum can answer that question.

Now one of my clients had this issue last year and it took 8 months to resolve ... small company and the employer mailed in the W-2 & W-3 which means they needed to be manually entered or scanned. Only she had this issue out of all the employees so who knows what went wrong ? The SS administration and IRS never gave an explanation but the employer had to comply with the government request for information.

I am in the same boat.

I’m dealing with the EXACT same thing. My employer swears they reported my i

wages over 5 times and yet IRS has no record of it. Social security doesn’t even have record of my wages. I filed Jan 31, 2019 and it’s September 17 and I’m still waiting. They did 3 60 day reviews and now they’re on a 4th and still nothing.

I filed my return beginning of February and have yet to receive it. I got letters stating that I needed to allow so and so many days for review and still nothing. Last week I had finally had enough and called the tax advocate number they provide and told them the last time I got a letter was in May. The young lady took a look into my return and told me I needed to call AQC or something like that with the irs and they would tell me what to do. So I called and was told my previous employer didn’t report my income and that I could send them my last paystub from the employer on a company letterhead with YTD INCOME, Taxes withheld, social security via fax or email to them and within a 6 week period( which she stated they tell everyone) they would process and refund my return. The tax advocate number is on the irs website if needed

If you filed your taxes correctly and did not lie I would say DO NOT WORRY. I received a 90 day letter from the IRS because one of my employers supposedly did not report my wages. I called my employer they resent my info to the IRS. Literally 18 days after receiving my 90 day letter, my status online was updated with an expected refund date.

I am also in the same boat. The irs sent me a letter saying my refund is being reviewed( I filed Jan 28th) but didn't give a specific reason. I got laid off two weeks ago, as I was filing for unemployment I noticed the employer hasn't sent in any wages since ive worked for the company.I am struggling to pay my morgage/bills, raise my kids and live like most Americans.I was counting on my refund and have never had an issue since I started working 14 years ago. I also filed with turbo tax. I would like to know what to do and where to start?

The first thing you should do is contact the employer and ask them if they submitted the W-2 to the Social Security Administration.

Then, make an appointment with your local IRS office and bring a copy of your W-2 and tax return and tell them what happened and what steps they or you can take to correct the situation.

I also use turbo tax and i am dealing with the same exact thing.! This is crazy! I know my employers reported my wages. The guys i work with had already gotten their tax return and we have been working together for the last 2 years. The IRS is saying that two of my employer's did not report my earnings. But when I talk to them they said that they sent it in. I have three kids and I'm about to lose my home over this. To top it off everything with this coronavirus going on.

It still says my return is still being processed and a date will be given when a available. I faxed a letter head from my company w/ all my info on it, my last check stub from 2019, and my w2 from 2019, along with verification of hardship to the taxpayer advocates 2 weeks ago.

well compounding this hot mess of a tax return situation we also are in unfamiliar waters with Covid-19 and the fact that all IRS in person offices are closed....so we cant even go talk to someone about what happened. I am pretty sure that by the time I get this tax return I can use it for my 15 year old sons first college tuition payment. Good Luck to all of you going through this...Keep us all posted on an updates.

I am dealing with this problem. Only thing is that I am not so sure my previous employer actually sent out my documents as they said they did.. I remember when I worked for them errors happening with the IRS etc.. Now my garnished wages are somehow lost... IDK.. IRS is also a douche.. they took forever to tell me the reason why my return was being placed on hold.. Why couldn't they just tell me the truth from the get go?? they took forever that they had 60 days.. I submitted my return in Jan, Feb ended which was not normal for me and then March - COVID-19 happened! more delay! I kept calling once a month cause they **bleep** at you that you don't need to do anything and just wait until they ask you to do something SMH.. so now I am about to experience a hardship and now JULY they tell me well did you have two employers cause we only see one... I'm like yeah I did have two!.. like MF** you take this long to actually tell me what was wrong in the first place!,.. and I'm assuming they still have not contacted my previous employer either SMH and my previous employer just states that they submitted along with everyone elses... sigh

I have a w2 why isn’t that enough ?

A third grader can forge a W-2.

Calling the IRS will not make things go faster. Bugging your employer will not make things go faster.

Hey how are you hope you got this resolved . Have a great day
