      <description>He lives with me 10 months out of the year I support him 100%, BUT i have a court order that allows my EX to claim him this year.&amp;nbsp;&amp;nbsp;He doesn't support him at all.&amp;nbsp;&amp;nbsp;Is there a way around it?&amp;nbsp;&amp;nbsp;He is attempting to allow his girlfriend to claim the child bc he is self employed and the deduction is not necessary for him this year.&amp;nbsp;&amp;nbsp;What do I DO?</description>

      <description>In this situation, you are correct that the girlfriend cannot claim your son just because the father gave her permission.&amp;nbsp;&amp;nbsp;In this case, you should paper file because once you do, the IRS will do an investigation to see who claims the child.&amp;nbsp;&amp;nbsp;Unfortunately, when that happens your husband can step in and amend his taxes to claim because technically it is his year, but if you do not do the paper file the IRS will just allow the girlfriend to claim because no one disputed it.&amp;nbsp;&amp;nbsp;Let me know if you have any other questions.</description>

      <description>What I've been told is: the IRS doesn't even care about court orders.&amp;nbsp;&amp;nbsp;They look at the tax code.&amp;nbsp;&amp;nbsp;If the rules say you have the right to claim and the court order says this is his year then you should give him Form 8332 giving him the right to claim, or risk contempt of court.&amp;nbsp;&amp;nbsp;But if the court order puts conditions on it that he doesn't meet then he doesn't have a case in the local court.&amp;nbsp;&amp;nbsp;But I am certainly not a lawyer.</description>

I know that he(the father)&amp;nbsp;&amp;nbsp;is not on the girlfriends tax return and he should according to our court order return the dependent back to me. Not a girlfriend.&amp;nbsp;&amp;nbsp;I am hesitant to spend any of the money i will receive just in case but i certainly dont think i am the one in the wrong here.. in the future if he was to claim him will i have to sign the 8332 form in order for the father to use our child as a dependent? Or is the court order enough for him to file with?</description>

Child Rules&lt;/B&gt;&amp;nbsp;have to be met:&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;B&gt;To be a
Qualifying Child&lt;/B&gt;&amp;nbsp;-&lt;/P&gt;&lt;P&gt;1. The child must be your son,
daughter, stepchild, foster child, brother, sister, half brother, half sister,
stepbrother, stepsister, or a descendant of any of them.&lt;/P&gt;&lt;P&gt;2. The child must be (a) under
age 19 at the end of the year, (b) under age 24 at the end of the year and a
full-time student or (c) any age and permanently and totally disabled.&lt;/P&gt;&lt;P&gt;3. The child must have lived
with you for&lt;B&gt;&amp;nbsp;more
than half of the year&lt;/B&gt;. Temporary
absences while away at college are considered living with you.&lt;/P&gt;&lt;P&gt;4. The child must not have
provided more than half of his or her own support for the year.&lt;/P&gt;&lt;P&gt;5. If the child meets the rules
to be a qualifying child of more than one person, you must be the person
entitled to claim the child as a qualifying child.&amp;nbsp;&lt;/P&gt;&lt;P&gt;6. The child must be a U.S.
citizen or U.S., Canada or Mexico resident for some portion of the year.&lt;/P&gt;&lt;P&gt;7. The child must be younger
than you unless disabled.&lt;/P&gt;&lt;P&gt;NOTE: However, if a &lt;B&gt;divorce decree &lt;/B&gt;or &lt;B&gt;court order &lt;/B&gt;gives your ex-spouse the right to claim the children, he can do so if he attaches key pages of that document to his tax return.&amp;nbsp;Whereas, if no divorce or separation decree states that the noncustodial parent may claim the exemption or there is no written declaration from the custodial parent, tiebreaker rules are in effect. The parent who the child spends the most time with may claim the dependent.&lt;/P&gt;&lt;P&gt;For
