      <description>&lt;P&gt;&lt;B&gt;It depends. &amp;nbsp;&lt;/B&gt;If you feel that you have the proof that she lived with you at least 183 days and you wish to claim her, you will need to mail in your return. &amp;nbsp;From there, the IRS will send out correspondence to you and the other party who claimed her, asking for proof on the claim. &amp;nbsp;The situation can be a bit complicated, because, since her mother died last year, the IRS will consider your daughter as having lived with her mother&amp;nbsp;&lt;I&gt;all year&lt;/I&gt; if she lived only with her up to that point, and someone filed your ex's return as a deceased taxpayer claiming your daughter.&lt;BR /&gt;&lt;/P&gt;&lt;P&gt;Here is a useful page provided by TurboTax on this subject:&amp;nbsp; &lt;A href="https://turbotax.intuit.com/tax-tools/tax-tips/Family/What-Happens-When-Both-Parents-Claim-a-Child-on-a-Tax-Return-/INF14352.html" target="_blank"&gt;Click
