&lt;/P&gt;&lt;P&gt;There is no need to include the non-resident spouse on a resident alien taxpayer's application for automatic extension&amp;nbsp;of time to file a federal tax return. At this point, the non-resident spouse is not required to file a tax return, and the resident alien taxpayer does not have to declare a filing status (MFS, MFJ) with the request for extension.&lt;BR /&gt;&lt;/P&gt;&lt;P&gt;You can file a joint 2016 U.S. tax return with your non-resident
spouse and she can be treated as a U.S. resident for U.S. Federal Individual
Income Tax purposes.&amp;nbsp;&lt;/P&gt;&lt;P&gt;She will have to&amp;nbsp;obtain an Individual
Taxpayer Identification Number (ITIN) using Form W-7,&amp;nbsp;you will have to&amp;nbsp;file your return by mail

you will have to&amp;nbsp;include a statement, signed by both of you,declaring that one spouse was a nonresident
alien and the other spouse a U.S. citizen or resident alien on the last day of

apply. Attach a valid federal income tax return, unless you qualify for an
