I tried to simply not claim him as a defendant, but then I have to say he wasn't a student and fear that will cause trouble with his return. How do we make this work with the least amount of difficulty or issues with the IRS?

If your son is under 24 at the end of 2016 and a full tim...

If your son is under 24 at the end of 2016 and a full time student, you can claim him as a dependent if you provided more than half of his support. You can also claim his education expenses (on form 1098-T).

If he already filed his own tax return and claimed himself, he should amend his return to indicate that he is claimed as a dependent by someone else.

The IRS will take between 12 and 16 weeks to process your son's
amended tax return. During this time you cannot e-file as your return
will be rejected due to the fact that you are claiming your son as a dependent..

You'll need to file by mail.
You prepare your return and claim your son as a dependent. You print your
return, sign it and mail to the IRS address indicated by TurboTax.
The
IRS will also take 12 to 16 weeks to process your paper return, And by
that time, they would have processed your son's amended return. And
everything would match.
Is there a way to leave his tax return as is and fix mine to still be correct? He is 22, but also pays a small amount of rent (10% of income). In short, we are trying to prepare him for living on his own while providing him the support he needs due to being autistic. Plus, neither of us wants to wait 3 months for our return.
