No, you should not mail in any documentation with your Tax Return to prove that your Dependents have been with you when you mail your return.

You need to wait until the IRS actually requests the information from you via a letter in the mail.

Unfortunately, if you send the documentation to the IRS before they request it, things get mixed up and it ends up taking them longer to process your return. My best advice is to gather your documentation now so that it is ready to mail as soon as the IRS sends you a request letter.

Im going through a divorce. It isnt final. My ex filed HOH. We didnt have an agreement yet the non custodial parent claimed my children who were physically with him only 30 days total on visitation for summer 2020 and Christmas 2020. He kept the refund and stimulus. My e-file got kicked by the system because he filed first. Now I have to file a paper return. Prolonging the time to get the refund and stimulus for my household. Would the court order from the Attorney General naming me as the custodial parent be proof enough that the children reside with me?
