Turbotax error - Box below line 7 in the Dependent Section of Form 1040

I believe Turbotax is incorrectly checking this box for me. This box deals with filing status of MFS or HOH. My box is checked by Turbotax tax even though I am divorced and filing as HOH.

If you qualify as Head of Household, when you enter your marital status (single or married filing separately) into MyInfo, and then enter your qualifying dependent, TurboTax will offer HOH as your filing status.

My question isn't whether I qualify as HOH. My post was to suggest that turbotax is incorrectly checking the box on the Form 1040. I am unmarried (divorced) and filing as HOH, so it seems like this box shouldn't be checked by Turbotax

But as you just said in your top question….MFS or HOH. It says -OR- HOH and you said you are filing Head of Household.

If you are filing as HOH that box should be checked. Not sure what the fuss is about. There is no place to say "divorced" on a tax return.

Look at line 12e on your Form 1040. Are you getting the HOH standard deduction of $23,625?

I itemized my deductions so my line 12e amount is $25,413.

I am certainly no expert, but it seems to me that this box shouldn't be checked if I am divorced and filing HOH. The box seems to indicate that it should be checked only if you are legally separated, or MFS and lived apart from your spouse

Above "Digital Assets" is the box for HOH checked for your filing status? As long as that box is checked you are fine.

Yes that box (HOH) is checked for my filing status. Still not sure it makes sense to me. What if a person was never married and claiming HOH for filing status. Would that person think that box should be checked?

This is also happening to me—I am married filing separately but am still together with my spouse and live together year round. Did Turbotax ever solve the issue? It seems to be some sort of glitch? Multiple agents weren’t able to help me figure out why the box is being checked (and they aren’t able to see the pdf of the 1040 because it pops out into a separate window and I cant send screenshots)

If you lived together with your spouse at any time July 1-December 31, and you decide to file separately, head of household is not an option. Make sure to answer the questions in Personal Info about your status.

Yes you are married.
No, you do not want to file this return with your spouse
Review the answers to all the questions for your dependents

This doesn't answer his question. And I have the same question too. I'm guessing that "legally separated" is equivalent to "divorced" on federal forms, even though they are distinctly different in some places, like Virginia for instance?

To file as Head of Household, you need to either be Single (divorced, never married) or if still married, did not live with your spouse the last 6 months of the year. You also had to pay over 50% of your household expenses.

I agree with the OP and the other two posters that are having this problem - the question has not been answered properly by the specialists. That box under the dependents section is being checked for me by the software but I also do not believe it should be checked based on what it says on the form (see below). I am divorced 8 years filing as HOH.

"Check if your filing status is MFS or HOH and you lived apart from your spouse for the last 6 months of 2025, or you are legally separated according to your state law under a written separation agreement or a decree of separate maintenance and you did not live in the same household as your spouse at the end of 2025."

Was there ever any resolution on this?

No, Turbotax never resolved my issue. I did finally raise it through the chain to an actual CPA (the “tax experts” are not CPAs) and she confirmed that the software should not be checking this box for my situation (married filing separately and living together in same house for entire year). This is a new question in the 2025 1040 so most of the reps are unfamiliar with the meaning. They suggested I clear and start over since it seemed to be a glitch, but ai had already paid the Turbotax fee so you cannot clear and start over. Tried to get a refund and they emailed me saying it was approved but still haven’t received the money. The customer service has been abysmal all around I will never use Turbotax again. Make sure you raise the issue to a CPA.

Wow thank you. Sorry to hear about your situation hopefully you get the refund. I'm going to white it out and hope for the best. Played for well over an hour in the software to try to figure out how to blank it manually out but no success.

Glitches happen, especially with changes. But this is serious enough (taxes) that responses should be accurate and fixes should be very timely.

You don't need to check this box. This relates to the earned income credit (EIC). I'll spare the details, but if you want to read into it further, you may see Special rule for separated spouses under Dependents section of 2025 Form 1040 instructions, page 44.

I FIXED IT ON MINE (desktop version)...

It's checking this box based on an assumed separation/living apart... The only place you can seemingly change this if you go into the 'forms' setting and go to the EIC Worksheet. There is an MFS box between lines 9 and 10. This seems to be the only place that TT allows you to edit this information. Once corrected, the check on the 1040 disappears.
