In TurboTax, you do not have to indicate this in the Personal Info section- though you most likely saw the option for your spouse.

For you in 2025, you are a Dual-status individual for tax purposes. This means you report and pay tax all income for the time you are a U.S. resident. For the time you were a nonresident, you would only need to report income from U.S. sources. You would need to write "Dual-Status Return" so you would need to print and mail your return. You must also attach a statement to your return to show the income for the part of the year you are a nonresident (which can be a 1040NR with "Dual-Status Statement" on the return.)

See Taxation of dual-status individuals.

@safperbox . agreeing with my colleague @MaryK4 , for her quite complete reply to your post. However, I would like to add just the following:

(a) If you were legally present in the USA during 2025 prior to the adjustment of status, then your start of residency may be earlier . However, if you were not present or was on "exemption status", then your admission date is the date for start of residency. See --> Residency starting and ending dates | Internal Revenue Service

(b) If your start of residency is not the first day of the calendar year ( Jan 1st ) then you cannot use standard deduction, which requires a full calendar year of presence.

(c) From the date of residency start date you come under the FBAR ( form 114 at www.FinCen.gov) and FATCA ( form 8938 along with your return ). See --> Comparison of Form 8938 and FBAR requirements | Internal Revenue Service

Is there more one of us can do for you ?

Hello, thank you for your response.

I have a similar situation and am unsure about the rules for filing a full-year return versus a dual-status return. Since I am unable to file a dual-status return through TurboTax, does this mean I need to report all income on a full-year return, including the period from January to April?

If so, would this result in double taxation for that period, given that I also filed a final return in Canada? I understand that foreign tax credits may be available for the non-resident period, but I am unclear how to determine those amounts, particularly since deemed dispositions were reported on departure.

Would it be acceptable not to report income earned from January to April if none of it was U.S.-source income?

I want to ensure I am complying with the rules, but I would appreciate guidance on the most appropriate approach that would be acceptable to the IRS.

Thank you very much in advance for your assistance.

@user17745382418 ,

(a)_ When did you actually enter the USA -- exact date

(b) Which country are you from ?

(c) Assuming that you are on a work visa ( I am assuming that you are not a GC ), you became a Resident for tax purposes once you passed the SPT. The residency while determined separately for each calendar year, the start of residency for the first year is the first day of legal presence ( counting start day ).

(d) What IRS is looking for , is a return covering the whole calendar year -- that is why you need to account for both Non-Resident/NRA period and the Resident period,

(e) So in your particular case, if I assume that you were admitted to the country with a work-visa on 05/01/2025 and you stayed herein all the way till 12/31/2025 ( except for minor/short trips abroad), then you have

                (1) NRA period of 01/01/2025 through 04/30/2025 -- requiring 1040-NR and reporting ONLY US sourced income ( Turbo not supporting this form )

               (2) RA period covering 05/01/2025 through 12/31/2025 -- requiring form 1040 and reporting world income for the period.

                (3) you also cannot use standard deduction because of partial year on RA status.

(f) You complete the form 1040 using TurboTax ( fully supported ) , print, date sign -- getting ready to file by mail

(g) you download the form 1040-NR from www.irs.gov, ( it is a fillable pdf), fill it out, print, sign and date ---- I am assuming here that you had zero US sourced income during your NRA days.

(h) Now collect both the 1040 and the 1040-NR , legend the first page of the 1040 with "DUAL STATUS FILER ", put it on top, attach the form 1040-NR and now mail the whole package to the IRS office ( shown at IRS.gov ) for your state.

(i) Note that for your state, because you filed federal by mail, you need to include a copy of the federal return ( at least the form 1040 ) and can file by mail as well or if you like e-file ( through TurboTax ).

I hope this makes sense . Is there more I can do for you ?

@user17745382418 ,

(1) I made two mistakes in my response -- even though you had mentioned a GC and not work visa, my reply was , while applicable in toto, assumed/ mentioned ( "Not GC"). But the answer / process is correct

(2) forgot to mention that this ritual of filing by mail and stamping the 1040 ( the resident return portion ) with the legend " DUAL STATUS FILER" is only for the first year.

(3) note that I have been assuming here that you were admitted with GC on 04/30/2025 and that you did not have any other / prior stays during the period 01/01/2025 through 04/29/2025. While unlikely, earlier presences may influence the start date of residency.

(4) depending on the type of pension, the tax treaty may have impacts as to which country taxes the income and /or eligibility of foreign tax credit ( from the US).

Is there more I can do for you ?

And if not, then next year

Thanks a lot for your help. As previously stated, I officially became a resident the day I entered the US with a GC visa on May 26, 2025 coming from Brazil (no tax agreement between US and Brazil). This was my first day in the US territory in 2025. However, I already have an American bank account and T Bills bought through an American brooker for years. As previously I'm supposing that during this 2025 non-resident period I'm exempt from US tax. Even so, I have to fill in both the 1040 and the 1040-NR?

1. you file a form 1040-NR covering any US sourced / connected income ( US Govt. savings bond interests are not taxable income ) --- even if the earnings are zero during this NRA period-- just to provide a full year return.

2. you file a form 1040 covering your Resident period -- 5/26/2025 through 12/31/2025, prepare with TurboTax, itemized deduction, Print , sign, date and Mark on first page with "DUAL STATUS FILER" and file by mail together with the 1040-NR above.

Hello @safperbox , I have the same situation where I became a citizen during the year and will need to complete a dual return. Based on my age, Turbotax is including a senior deduction of 6,000 but I believe I am not entitled to this deduction this year. I was able to select the itemized deduction (instead of standard) but cannot get rid of this senior deduction. Can you please tell me how to remove this deduction? Thank you!

@user17745382418 , this additional senior deduction is available even if you itemize -- see this from the IRS :

--> One, Big, Beautiful Bill Act: Tax deductions for working Americans and seniors | Internal Revenue Service

"Deduction for Seniors

New deduction: Effective for 2025 through 2028, individuals who are age 65 and older may claim an additional deduction of $6,000. This new deduction is in addition to the current additional standard deduction for seniors under existing law.

The $6,000 senior deduction is per eligible individual (i.e., $12,000 total for a married couple where both spouses qualify).

Deduction phases out for taxpayers with modified adjusted gross income over $75,000 ($150,000 for joint filers).

Qualifying taxpayers: To qualify for the additional deduction, a taxpayer must attain age 65 on or before the last day of the taxable year.

Taxpayer eligibility: Deduction is available for both itemizing and non-itemizing taxpayers.

Taxpayers must:

include the Social Security Number of the qualifying individual(s) on the return, and

file jointly if married, to claim the deduction."

This shows up on Schedule 1-A section V , line 36a, 36b and finally line 37.

Does this make sense ?

Hello, to clarify, if I was only a resident for part of the year and need to file a DUAL status return, I do not believe that I am eligible for the standard deduction and senior deduction. Quote from IRS:

You cannot use the standard deduction allowed on Form 1040, U.S. Individual Income Tax Return. However, you can itemize certain allowable deductions.

So my question is, how can I remove the senior deduction? I was able to remove the standard deduction but cannot seem to remove the senior deduction? Thank you!

Yes,there is a way to remove it but before you do, have you considered to file as a full-year resident? Because, since you pass the substantial presence test for being in the US for more than 183 days in 2025, you may file as a resident alien for the entire year. If you file as a US resident, you may claim the standard deduction and the senior deduction.

If you wish to file a dual status return, you can remove the senior deduction by deleting Schedule 1-A in the return.

TurboTax online.

Go to tax tools

tools

delete a form

locate Schedule 1-A then press delete.

Log out of your return to save the change.

If using the Desktop software, go to the forms mode. Look for Schedule 1-A and select it. Once it appears on your screen, delete it at the bottom of the form.

generally agreeing with my Colleague , about being treated as a resident for the whole year . To achieve this though you need to request to be treated as a resident for the NRA period --- just a request that you want to be treated as resident for the whole year. ( it is kind of like exercising the first year choice ). It also means that your world earnings during the NRA period are subject to US taxes and of course any taxes you paid to another country during that period is eligible for Foreign Tax Credit.

"

Statement required to make the first-year choice for 2025.

You must attach a statement to Form 1040 or 1040-SR to make the first-year choice for 2025. The statement must contain your name and address and specify the following.

That you are making the first-year choice for 2025.

That you were not a resident in 2024.

That you are a resident under the substantial presence test in 2026.

The number of days of presence in the United States during 2026.

The date or dates of your 31-day period of presence and the period of continuous presence in the United States during 2025.

The date or dates of absence from the United States during 2025 that you are treating as days of presence.
