PER IRS GUIDELINES:

Here is what to do to address overdue 2023 and 2024 non-profit tax returns, including how to file and potential penalties.

1. Determine which tax form is needed

The first step is to figure out which version of Form 990 your organization was required to file for 2023 and 2024. The form depends on the organization's gross receipts.

2. File the overdue returns

You must file the outstanding returns as soon as possible. File one return for each year that was missed. For example, a 2023 return and a 2024 return.

For Form 990 or 990-EZ: The IRS requires that you file electronically. Use a tax professional or an IRS-approved e-file service provider. If you have a calendar year-end (December 31), your 2023 return was due on May 15, 2024, and your 2024 return was due on May 15, 2025.

For Form 990-N: Small organizations must file the e-Postcard electronically through an IRS-approved service.

3. Address late-filing penalties

The consequences for late filing vary depending on the form and the organization's gross receipts.

For Form 990 and 990-EZ

For organizations with gross receipts less than $1.2085 million: The penalty is $20 per day for each day the return is late, with a maximum of $12,000 or 5% of the organization’s gross receipts, whichever is less.

For organizations with gross receipts greater than $1.2085 million: The penalty is $120 per day, up to a maximum of $60,000.

How to request penalty abatement: You may be able to have penalties waived if you can demonstrate "reasonable cause" for filing late, such as a death or serious illness in the organization's leadership. You must submit a written statement with supporting documentation to the IRS.

For Form 990-N (e-Postcard)

There is no monetary penalty for filing a Form 990-N late.

However, if you fail to file for three consecutive years, your tax-exempt status will be automatically revoked. Since you have missed 2023 and 2024, you must file the overdue returns immediately to avoid revocation for a third missed year.

4. Consider the risk of losing tax-exempt status

The most serious consequence is the automatic revocation of your non-profit status. This happens when an organization fails to file the required returns for three consecutive years.

If your organization has a calendar fiscal year and missed 2023 and 2024, failing to file in 2025 would trigger revocation.

If your status is revoked, you will need to file an application and pay a fee to get it reinstated.

5. Take steps to prevent future lapses

To avoid missing future filing deadlines, create a proactive system:

One thing to clarify---TurboTax does not support or provide the forms to file a return for a non-profit. You are on your own to get the forms from the IRS or to seek local paid tax help.
